Misleading website advert. Can i get my money back?

The advert is this: http://www.vauxcentre.co.uk/index.php?product_id=441517&option=Prod_detail&image_id=157754

I thought there was perhaps a problem with the website which could be taken advantage of. It read to me as the following:

O/S headlight: £40.00
N/S headlight: £40.00

Yet if you order "both": £40.00

Result!!

+ £7.00 postage = £47.00 for 2 headlights.

Then a friend says he tried the site a while ago & to get it, you need to select "quantity: 2" (even for both sides). As it stands with my order, the warehouseman will just select whichever side he pleases - O/S or N/S.

Now to me...

"both sides" @ "quantity: 1" means that i should get both sides at the advertised price.



I have emailed them saying that if this has been all confusion, then i'd like to cancel the order as i'm expecting both lights.

Just wondering what my rights are here. Am i well within my rights to cancel here & expect a full refund (i've only just ordered)?

    First, check if they can add a note to your order to send whichever you wanted, then it is not so much not as described but poorly implemented website. Either way you can cancel under the DSR's assuming it is a UK company, and can do so for free and without penalty.

    It is UK based AFAIK. I don't really want both items sent out at a cost of £80. I was paying purely based on the sale being £40.

    I don't want the hassle of receiving the item, only to then have to send it back because it's only 1 headlight.

    Hopefully they get my email in time.

    It is obvious from reading the advert and applying common sense that it is £40 per headlight and £80 for both.

    However, when selecting "Both" from the dropdown, I would expect it to say £80 as the total, not £40. This is an obvious mistake. You went through with the checkout to try your luck but this will probably just result in time wasted for both parties.

    if you read the terms under order not accepted

    Orders not accepted.
    We may not accept an order for the following reasons:
    • The part was incorrectly priced or described
    • The part is out of stock.
    • The inability to obtain authorisation of your payment.

    you may not get it anyway. they may pick up at the point of the order going through notice the price, then they could cancel the order.

    I agree with you.

    I thought it was a decent deal & i was trying my luck. I, like you said, expected it to then read £80 if that was the way it was working, but it didn't, so i thought i was on to a winner.

    Both to me reads as plural - both O/S & N/S. Not one or the other. Both at a quantity of 2 to me, reads 2x O/S and 2x N/S headlights, meaning you're getting 4 singular items.

    It's like using the word "both" instead of "pair". If i say i want a pair, i don't expect to have 1. If i say i want 2 pairs, i expect to get 4.

    So when payment went through & it said both = £40, i thought result.


    It was only when i was told by someone else after i'd made payment that they had used the site previously & gone through the same thing, believing the same thing, only to then discover it was poorly designed.

    Did you read the OP? They are not asking whether they are entitled to both lights for £40. They are asking if they are entitled to a refund.

    The answer is yes.
    One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

    Email and cancel under DSRs for full refund inc postage. Hopefully it hasn't been sent yet so there's no mess on.
    If at first you don't succeed, maybe bomb disposal isn't the best career choice.

    Emailed them within 30minutes of paying last night asking for the order to be cancelled & refunded in full. I'm hoping that they need to consult their computer system for the orders & will see the email in time.

    I know at least 3-4 other people have also done the same at the same time as me too.

    They should really design it.
