Faulty iPhone, do I have any rights?
Options
The home button on my iPhone has stopped working, and as its just over a year old it's out of warranty and Apple won't repair it.
I purchased the iPhone online directly from Apple for £599.
Despite it being out of warranty, I've read lots of stories with consumer electronics faults (not sure if it applies to phones?) whereby people have rights for up to six years?
And another thing where things should work for a reasonable length of time? Seen as phones are commonly sold on 2 year contracts I'd say 13 months is well within that limit.
Can anyone explain to me what, if any, rights I have with this?
Thanks

Unfortunately, our legislators were unable to create anything more clear than vague 'reasonable'.
You can take Apple (as a retailer, not as a manufacturer) to a small claims court, but the onus is on you to prove that the phone was faulty (or not fit for purpose) when you bought it. And it will be up to the court to decide what is 'reasonable' in this case.
Recent pretty hot discussion on slightly different subject: Orange, defective goods and SOGASA1982
BTW, AFAIK Apple are known to exchange faulty handsets on refurbished ones for about £100-£150 charge.0 -
Hmm, the phone wasn't faulty when I bought it, but has developed a fault
The phone is insured but unfortunately they won't have anything to do with a genuine fault, only damage.0 -
Hmm, the phone wasn't faulty when I bought it, but has developed a faultIf you bought your item over six months ago, you may have to prove the fault was not caused by accidental damage or wear and tear. You can do this by getting a second opinion from an independent expert (see link below).0

Out of interest how did you approach apple to replace it & what did they give as a reason for not replacing it.
From my experience and many others is that apple have one of the best customer services around, and usually with an appointment at their genius bar, and being honest and polite they usually replace them there and then, even with cracked screens, being out of warranty or with water damage.:beer:0 -

Thanks, telephone support rejected me but made a Genius Bar appointment and they replaced it, for free, there and then0
