On the one hand, it will cost you a lot more than £100 if this chain falls apart. But on the other hand, the mortgagee-in-possession isn't likely to find anyone else who is ready to complete by 19 September so they get no benefit from refusing to extend the completion date if that is what the chain is forced to do.
You'd have to call someone's bluff and its not easy to know if they'll blink. For the sake of £100, I don't think I'd be playing chicken with a repossession.0 -
Well the latest development is that second in the chain (Mr Awkward) hasn't confirmed to his solicitors that he will move on 19th. He has confirmed, however, that he will not be paying the £100 to the FTB. So even though I have now told my solicitor we will pay the £100, it's irrelevant as the FTB is insisting on £100 from each party in the chain and won't accept anything less.
I am tempted to use my house deposit to get on a plane tonight to somewhere exotic and not come back!0 -

You say that the next up the chain wanted 26 August. He was almost certainly swayed by the FTB's tenancy date but was not prepared to accept the FTB's date of 26 July, thus unilaterally digging his heels in for 26 August. If he had taken into account the constraints at your end of the chain, 18 August would have been reasonable, and the FTB would be looking at a week of overlap

I appreciate that the FTB is annoyed with the second guy up. But why make us all pay? The cause of all these issues is the guy who is second in the chain. We have now agreed to the £100, as has our buyer and her buyer. Only second man up won't agree, and as a result FTB won't agree the completion date of the 19th. They are both being as difficult as each other. FTB is now £100 down as second man up is the only one who won't pay. He is prepared, apparently, to let it all fall through over £100. Which is exactly what people on here were saying I shouldn't do.

but you're hearing all this through chinese whispers, in fact 12 (6 estate agents and 6 solicitors) plus bits added in by the buyers and vendors you're in contact with
you dont really know who is at fault or why or whats been said in reality. its the most frustrating thing, but i think the poster above is right that thet bank are unlikely to find someone in this short time who can complete sooner so you will be ok,
the ftb probably said he wanted the vendor to pay his extra months rent as it seemed to have turned out to be unecessary (although may not be now) and the second in the chain may have said to his sol, 'make the others in the chain share it' and it all spiralled from there?
i dont know but i think i had a mini nervous breakdown after moving and didnt even realise it until months later. awful0 -

Me too! We also had other horrendously major things going on with some of our friends and family. I know we're both still 'coming down' from it all four months later. I've never had so much stress in my entire life. Apart from it bringing on a horrendous bout of vertigo, I'm still breathing, but my heart's never been the same since (and hubby was in hospital with probs with his!)!
Honestly, just do all you can to get it dealt with asap. Your health and sanity's not worth it.

When, on the brink of exchange on the sale of our victorian terraced house we couldn't find the building sign-off for the rebuilding of the back of the house and were told that to have it signed off (20 years after it had been built) we would have to dig exploratory holes in the back yard to see how deep the foundations were, I cried for 12 hours then handed the whole problem over to my (very sensible) sister. She sounds just like me on the phone and she sorted it out for me. I had lost the will to live by then.
She and our estate agent, went down to the council offices and waited while the planning department went into their archives in the cellar and found the (pre-computerised) paper copy for our buyer's solicitor.
If she hadn't taken it all over, I reckon we'd still be living there.
