Employer wont clamp down on smoking law. Next step?

  • OP, are you the only non-smoker in your office?? There must be more people who don't smoke and don't like it when the smokers light up indoors. The fact is, it's illegal. I'm a smoker and wouldn't dream of lighting up anywhere than in my own home!!

    I was a non-smoker for about 6 months (hopefully will be again soon) and I remember how disgusting it smells when you don't smoke. Unfortunately, us smokers don't smell it like you do (our kind brain dulls down our taste and smell senses so we don't get too affected by our own disgusting habit).

    You have every right to work in a smoke free environment. As I said, that's the law!! I think I probably would anonymously report it to some body who can come and do a surprise inspection BUT as someone else said you have to bear in mind that they will probably know it's you who has instigated it. What is worse ... the can't fire you for it, but they might not be too happy. Which do you want more ... happy co-workers or a smoke-free workplace?

    Op re-read my posts - I actually agree with you on the smoking thing, and would def be reporting it if it was me! My point was, you seem to be going out of your way to look for things to complain about - who would even notice if car tax is up to date. And I take posts as they are - you said he has no tax, but we don't know if he has insurance - I don't ASSume!!! I merely pointed out lack of TAX does YOU know harm........ unlike smoking around you which is extremely selfish and dangerous!

    I never said its ok for people to be late paying their tax, but where I live enforcement officers are out with cameras checking tax everyday of the week, so I certainly don't get worked up about it - they will get what they deserve in the end!

    My sil was mortified to get a letter from the tax office a few months ago, they had flagged up on the computer that her tax had expired a month before, she was devastated that she forgot lol, but I had little sympathy to be honest! She only had to pay the bit she had missed though, no fine which is a bit silly!

    skint&scared - I work outside, not an office, but our outside has insides if you get me. There are store rooms & a canteen & toilet. To break it down *puts thinking cap on*....

    My immediate department has 4 members of staff. The dept supervisor is the biggest culprit of the lot (lighting up literally every 10-20 minutes). There's me. A 3rd lad is a social smoker (so will only do it when out in the pub). The 4th doesn't smoke, but he doesn't mind it - he can be in the company of it & it doesn't really bother him.

    We have a very close working relationship with another department, of which there are 6 members i think. Of these 6 members, 1 of them doesn't smoke, but like the one in my department, he doesn't mind being around it.

    Some of these are even smoking in company vehicles. When you get in the vehicle they've been in, it reeks. I've reported this also (as we have to move their vehicles around from time to time) but nothing really happens. It's just another wrist slapping.


    miss duke - who would notice? I did when he was bragging to me about getting away with not paying it. It's going back a while now, so i can't quite remember whether it was him or his mate who was bragging about no tax AND no insurance.

    But it's clearly one of those - we're not going to agree, so it's probably best we just leave it at that & agree to disagree.

    Wisely stopping innocent non smokers being poisoned and getting health problems, what better use. Of course they wouldn't have to do it if employers carried out their legal responsibilities properly without them. DH

    Actual inhalation of smoke can cause problems, going into an area that merely reeks of stale smoke has no harmful effects.
  • Well if people are out and about driving in company vehicles and are smoking, if the police see them they will be stopped and fined. I believe that it's illegal to smoke in any area that is more than 50% covered. That even includes doorways, so your canteen area is definitely out of bounds! It's tricky though, when it's a small business and the boss is one of the smokers. But the law is in place precisely to protect people like you. Unfortunately it sounds like you've tried everything you can and they are not going to stop. I'm afraid the only options I can see are shop them to the authorities or find another job. Good luck!

    I know of another person who's complained about this & nothing has even been said to him - he continues.


    So, it's been said that this can be reported higher & i'm all set to do it as i've had enough.

    Who do i report to? What name do i look for in the yellow pages / on google, what website do i contact etc?

    Ideally i'd like to do this anonymously.

    What is the procedure too? Do i contact them, tell them the info & then they come & investigate?

    Would prefer to not do over the phone. Don;t want to feel pressured into giving them info on who i am.
