Hi, My husband had taken out a joint mortgage with his brother 4yrs ago before we met. His brother started a relationship, his girlfriend became pregnant- husband asked to move out- girlfriend moved in stating that they would buy him out ( gave him £1000) stated rest to follow (£9000) which would cover the deposit my husband had paid in to the property.
3yrs later still no money and they hadnt taken out a new mortgage or transferred deeds. After so many failed promises husband contacted Santander to see where the mortgage was currently at. Found out his brother ran up £1600 arrears. Husband asked brother to put house up for sale, brother did, that had taken it off the market without informing husband as "hated so many people looking round his house". Husband contacted agent, put house up for sale again- brother has now moved out not informing anyone, non contactable and stated he wont pay mortgage-
WHAT TO DO? WHAT WILL HAPPEN? We cant afford the mortgage as have one wage and houshold to run, husband looks after little babies while i work. On paper he has no income. Contacted CAB, they asked about my income also- will i be forced to pay for a debt that is in my husbands/ brothers name- ive had no benefit from it. the house has no equity. On paper husband has no income as tax credits go in to my account. We dont have any joint debts, we share a first reserve account but no actual current account. Please help, I am really worried.
What will happen when the house builds up arrears, im confused, has anyone been in this situation?

Dreaming is a pointless exercise if it only serves to reinforce your own limitations.For my familys sake I no longer dream, I will plan and I will try and if I fail I will try and try again.
Failing is far better than dreaming.

I would probably roll with the punches. Your husband is clearly unable to pay anything towards the house, this will be quickly established and neither of you should worry about it. The house is gone as is his credit rating for a while.0

I'm sure more people will be along to help you soon but wanted to say something as regards what happened at CAB.
First of all this is not your debt so no one can come after you personally for it.
I think what happened at CAB is as follows. Many CAB have specialist money (debt) advisers. You will have probably seen a generalist adviser. The generalist adviser was probably asking about your financial situation because she/he wanted to see if you were eligible to see a money specialist to advise you about this problem. (This would be based on income/savings etc of the household less certain deductions)
It has nothing to do with you being liable for your OH's ebt.

where do you live, cant you move into the house?
if not, cant you rent the house out?
i cant see how you can even sell it because your brother in law is missing
im sorry to say it but i cannot understand why people buy stuff with family, it always ends in tears0 -
Can you move into the house? Or rent it out to cover the mortgage?
if not, put it on the market tomorrow.
Then gop for an order for sale from the courts if need be and get it shifted.If you've have not made a mistake, you've made nothing0
