    Its a civil issue.

    PPL and PRS collect money on behalf of the makers of music.

    If you keep playing the music without paying they can take you to a civil court for damages where you may be ordered to pay a fee to them for breach of copyright

    there are no hard and fats rules as to how they contact you assuming they are not misleading you.

    if it is too expensive then just dont bother - which is what it appears you have done done.

    as for the costs - they set the rules - you can always opt not to play music by their registered artists or play royalty free music.

    They will be looking for a Hook, if you reply they will have one.
    If they feel you owe them money, let them prove it in a court of law.

    They should have sent someone in to actually hear the music playing in the customers area and if they heard it they should have made themselves known to you, if they didn't then they are assuming because you are a cafe that you will have music. If they get in touch again tell them you have no music on, you just sing to your customers! If that doesn't pacify them, tell them to prove you have music on, now you don't so what can they prove?

    Surely this is nonsense?

    I do wonder though what would happen if this went to court... if op had a sign up saying 'no recording devices of any kind are permitted to be used on these premises' since they would need to prove he was listening to music to justify the invoice, otherwise it would be his word against theirs..................

    I run a market stall and also do country shows, there was a day earlier this year when the weather was great UK weather and no one really about apart from the cows and sheep in ajoining fields and other traders, so i decided to play a cd on portable cd palyer.
    I was then approached by someone from TS who asked to see my PPL and PRS licences, which natually i dont have, so i was told to stop playing the music where others can hear it.

    so it looks like you cant even play music to livestock
  • This is my point Texranger - you were given the chance to stop playing the music or pay for the license. I have just been sent a bill and a fine. I don't think this is fair.

    I was hoping for someone to point me in the direction of some sort of law/act protecting people from this sort of thing. I'm going to protest but feel i need the backing of some sort of official rights to quote.

    i was only told to stop playing the music as i did not have a licence. If i did not stop then TS told me they would have to remove my CD player and then report me to the licencing authorities.

    Just tell them that you work from home. End of story. They'll remove you from their list of businesses to harass.
