Local Court Nightmare

    Unfortunately there is no legislation for lack of knowledge/ignoance...the onus is on the individual to know their rights, etc.....like thats what one does in their spare time

    I have no shame admitting I have a lack of knowledge about the courts, there not a place I have a habit of dealing with, and hopefully that will be the last time I'll step foot in one in my life. So I will use my spare time on something more productive thanks!

    There is no need for insults you have not stated they dealt with bankruptancy (people on here are here to help you), it does not make sense and feel you are not giving enough information. If it is your local court and it is a bankruptancy court then they should be able to deal with it, unless you traded in a different area or lived somewhere else in the last 6 months? Where did you get the papers, on line or from the court?

    Sorry to hear that you both had a stressful day.

    Our nearest court that deals with BR is in the next city from us in our county. The court that serves my town is further away in a city across the border in the next county, go figure.

    Well it's not turned out too bad in the end, I rang the court in the other town myself later on and they tried to give the same appointment they told the first court they could give her in September, I ask the question "is it right that if I just turn up without an appointment you cannot by law turn us away?" she avoided answering this but took my number and said she will see if Theres anything she can do, she rang back an hour later with a new appointment for tmrw at 10am :)

    I still think you're missing the OP's point. The court they went to DID deal with bankruptcy and it was their local court (they did state this) however what someone considers 'local' to them isn't always the court they have to deal with (and needn't have anything to do with a previous address or business locality). The village I live in, for example, comes under a court (that deals with bankruptcy) in a town over 30 miles away (and in a totally different county) and it certainly wouldn't be the first place you'd think of when considering which court you'd have to use... the court in the large city only 10 miles away would be the obvious place but had I gone there when I filed for bankruptcy I too would have been turned away. When I queried it (with both courts, just be be sure) they were both astonished by which court I 'came under' and agreed it was a ridiculous system.

    I agree the OP maybe should have been a little more careful, but then hindsight's a wonderful thing... but it's not always quite as cut and dried as you may think.

    Its quite simple, you dont seem to be grasping the concept so ill try and make it as simple as I can, TOWN boundries and COURT boundries as I have found out are NOT the same. It probably dates back the dooms day book or some other ridiculse bit of burocracy but thats the FACTS.

    We paid our council tax to the council in that town, the town LEA run the 3 schools in our village and it is the nearest court by disatance hence we incorrectly assumed the county court would be the correct one to submit the BR at. I didnt state that it was a BR court because I stated we had an appointment with them to go BR, HOW would we have an appointment if the court didnt deal with BR??? thats would be an monumental F**K up by the court staff.

    Is it any clearer now? CAN WE PUT THIS TO BED??
