Simply be - missing parcel.

Hope someone can give me some advice 
I ordered some things from simply be which i didnt get. The delivery person left a card saying that my parcel was left with neighbours 2 doors down. Now these neighbours aren't the type of people to argue with, i knocked the door and they said it wasnt delivered there. These are the type of people that have police raids every other week :eek:
My delivery instructions were to leave by my back door if nobody was home, nothing about leaving with neighbours.
I contacted simply be and was told to wait 10 days so i said i wasnt happy waiting that long and they said ok wait 6 days. Now the 6 days are up i have re contacted them to be told i have to wait for a letter to arrive in the post, sign it and post it back and then wait a further 7 days for their investigations department to look into it :mad:
Is there anything i can do? All this time i am waiting those neighbours could be doing god knows what with my details that were in the parcel. I have explained this to simply be.
I dont think its fair that i have to wait this long for a refund when its their fault.

Under distance selling regulations they can take upto 28 days to refund money.
Personally I do not feel 10 days is unreasonable as they cannot just refund orders left right and center without investigating the claim.
Your obviously just frustrated, but these situations usually are just a waiting game i'm afraid.0 -
Well i have now done everything they have asked and they have sent me a letter saying when the parcel was 'delivered'. They dont seem to understand that it wasnt delivered here. I've explained to them several times from the start that it was delivered to a neighbour but they are saying they didnt recieve it so this letter is just repeating what i told them at the beginning :mad:
This has been a month now, and i have to pay my account for something that i never recieved. I'm at my wits end with phone calls and emails, what can i do now?
I still have the card which says which number house it was delivered to, i have told them this several times and offered to copy it and send them as my proof i never recieved it but they dont want a bar of it.

Simply point out that
a) You have not had the goods delivered to the requested address
b) The delivery driver chose to deliver it to an alternative address that you have not provided them with
c) a card was left advising where the goods were 'delivered' but on checking at that address they deny knowledge of having the goods
d) Their terms & conditions state that the goods will be delivered to your door or to an alternative address you provide.
In light of the above, delivery has clearly not been made as per their terms & conditions and as confirmed by the delivery card (don't lose that card). You have not therefore received the goods and can clearly request they either correctly deliver the goods, or refund you.
If you have previously requested a refund, them remind them that they have 30 days (starting from trhe day a refund was requested) under the provisions of the Distance Selling Regulations to refund your money.0
