Unfortunately the banks can now make you sell to get their money so a charge is not acceptable for me after struggling for many years trying to keep a roof over my families heads.

In theory, yes; but it is extremely rare for a judge to grant this unless, of course, the house is still subject to a mortgage provided by the petitioner.

Most PPI agreements cover the loan for a year, so even is PPI miss non selling? is proven then any compo would be limited to 1 years repayments.

It doesn't sound to me like you have exhausted the complaint procedure. If you had, the bank would have washed their hands of the matter and referred you to the Ombudsman at some point in the past three years. The fact that you don't even know who they are suggests that you have not contacted them, which is the final stage in the complaint process.
This may well work against you in court.

Have you asked for and been given a deadlock letter?

If not, you have not exhausted the internal process.

    Hi twasnotme,

You've probably already covered this, but have you checked that you would have been eligible for PPI? The unemployment cover is usually only available to full-time employees and I think you said you were part-time? Sorry if you've looked at this already but thought it worth asking! All the best with your court case anyway.

While that may be the case, it sounds like the forgery of financial documents is a serious matter indeed, regardless of whether the advice given was poor or not.
