Bank have forged my signature

I have been with my renowned high street bank for more then 20years now and have never had any severe debts with them. I have always had to keep my finances in check due to being a single parent with a mortgage to pay and on low income. However in 2008 I was phoned by my bank on several occasions with regards the fact that I was "entitled" to a loan.
As my mortgage was still in my ex partners name but the house was signed over to me, the same bank had offered a settlement figure due to my meticulous re payments over the years.
To abbreviate this issue, the mortgage dept accepted 5k, the amount of loan I was entitled too was coincidently 5k but as I needed home improvements I was told if I signed on the same day I would get another 5k and the financial advisor would put it through a few days later.
Out of the 10k I was loaned I paid 7k straight back to the bank. 2k of this was for my overdraft.
I was advised by the member of staff not to take out the PPI as he said it wasn't worth the paper it was written on or rather he looked at my wages and decided I couldn't afford it.
His statement on the matter was brief and in one sentence and nothing else was mentioned. Sadly in a few months later I lost my job. I complained to the branch about his poor advise. Nothing was done.
I managed to keep up the payments due to having the remaining monies from the loan but also had to live on it until signing onto job seekers.
I paid it for as long as I could but then found I had no monies to live on for myself and my children. The bank would not lower the payments and now I am going to court on the 15th August2011 to try and stop a charge being put on my home.
Even on a low wage I am representing myself as I cannot get legal aid.
Recently the banks solicitors sent me documents in relation to my case.

ON TWO OF THE DOCUMENTS THAT i HAVE NEVER SEEN ARE WHAT ARE SUPPOSED TO BE MY SIGNATURES STATING THAT I REFUSED THE PAYMENT PROTECTION.!
The bank have also stated that I have answered questions such as, how long will it take you to resume work if you were made redundant-two months,
how long are you paid if you are off ill-3 months (I was not entitled to sick pay)
have you any cover which protects you in the case of major illness-yes (I worked part time as a courier for a dry cleaners so thats a no)
How long will you salary be paid-12 months (I didnt get paid for a single days sickness so this if total fabrication)
Have you got life protection-yes (I have never had life cover)

The dates on these two documents have been changed, boxes have been ticked and crossed out and as I said I have never seen them.
I have given the documents along with copies of my signatures to a graphologist and am awaiting a report to present to the court.

I would like to know if this is a matter for the police and if I can prosecute the bank? I went to my doctors in 2009 for depression due to this debt and the stress I was under.
Any advice is welcome as time is ticking. I only have one week from today to get all my facts together. Legal advice is not available but citizens advice have been brilliant but their word cannot be held in court.
Help.

    Possibly.

I think you'd be better exhausting the bank's complaint procedure and the FOS if needed.

What I don't get is why a member of staff who gets paid more for selling the product would do this.

    Xmas Saver!
Cos they needed to sell the loan to hit the loan numbers, rather than the PPI to hit the PPI numbers. They sensed that if they mentioned PPI, they would make the customer delay on the loan so miss the sale there possibly?

It definately sounds like a matter for the police to me. It's fraud. Quite serious fraud at that I think.

A member of staff at another big high street bank once stole £50 off me (long story of how I know why). Always wished I pursued it more, but I was young and naive and just accepted the managers story that the CCTV was only turned on if the alarms went off.

    Can't say I believe him...

I have totally exhausted the complaint procedure...this has been 3 years now of letters ect. The signatures have only come to light in the past few weeks. I knew nothing about them before the solicitor sent them to me in prep for my case.

So what is the bank's final comment to you on this?

    What have the FOS said?

Do the signatures look anything like yours? If you're absolutely certain that you never signed these docs, and you have exhausted the bank's internal complaint procedures, then I would go to the police with your evidence. If true, someone has committed a serious forgery.

I totally agree with you on this...Strangely enough the member of staff left the company shortly after.
I work for a company where we have set targets each week. Once we reach that we can relax.

I forgot to mention that when he was phoning me he gave me his personal mobile number and an internal number which was not meant for the public to ring him on. I still have the evidence.

A charge on my house with the possibility of selling it to get their money that they have had back.
    Sorry what is the FOS?

Don't worry too much about the threat of a charge on your house. Even if granted, this will only be realisable when you come to sell, so you will have time to sort this out. (Sorry, I don't know what FOS is either).
