Private nursery threatening with court

    If it is signed by you/your partner then you've got no fall back other than to negotiate a repayment plan. (Will be cheaper than enduring a court battle, and will probably be better for the Nursery anyway - the court may order a lower repayment plan). If it is only signed by someone at the nursery then it's about as useful for them as an unsigned one. :)

    A "certified" copy is something that is guaranteed to be a genuine copy & not doctored.

    As for bank holidays; the local pre-school never charged for days they were shut for whatever reason, yet the staff were paid for 44 weeks per year (maximum open time was 39 weeks). This is what I find so ridiculous about nursery charges and would question the legality of such contracts. Unfortunately it appears those who need to use nurseries are held over a barrel when it comes to contracts & fees and unable to question such sharp practice.

    No it's not. It is simply something which is certified as being a true copy by, for example, a solicitor.

    It isn't necessary in this case. There is no suggestion of fraud and it would be extremely antagonistic to suggest otherwise.
  • Why would you leave your child in someone else's care without signing a contract? What other reassurances did you get that you would get the service you were paying for?

    If I had genuine concerns about either of my kids safety at nursery but didnt have the option to change the nursery, no amount of stress or worry would allow me to just push this aside until a later date when I had less going on! Sounds like your just clutching at straws now to get one up on them!

    Totally agree with you about the bank holidays, dont see how they can do that. My kids nursery was shut 3 weeks early before the summer holidays because of ongoing power cuts, they are taking the money I had already paid of septembers bill. If they tried to charge me for those three weeks where I couldnt take the kids in to cover their pay, I would have had a hissy fit. Charging for bank holidays is not on at all but if its in the t&c then not much you can do about it unfortunately!

    My kids nursery does still charge if they are off sick and if I take them out for a holiday I still have to pay half the normal bill (ive done this once and altho its in their t&c they didnt charge me) I also have to give a months notice on holidays otherwise I will have to pay the full normal bill.
    I also have to give a months notice when they leave.

    They still get 15hrs a week free, starting the term after their third birthday.

    I was in a very dangerous situation and had 1-2 weeks if that to make my decision. Towards the end it was becoming very very unethical and no matter how much money I was on, how much benefits I was given in the job or how much quitting my job would seriously make me and my family struggle I was not prepared to take part in criminal activity. Its a very very long story which I'm not prepared to explain. And it would be stupid of me to do that on an internet forum.

    Due to my work hours IF YOU READ MY PREVIOUS POSTS you will see that I said I was unable to sign anything in the beginning this was left to my partner. I saw that the nursery was approved by Ofsted, I viewed the nursery and was happy with it and had no problems up until the latter weeks as I have mentioned before. I am not trying to get one up on anybody. My concerns were mentioned separately from anything else. I had no intentions to use this against them in court and it had nothing to do with the money OBVIOUSLY. You are all putting words in my mouth.

    Yes, I did read your previous post yet I still do not see how the hours you work in any way stopped you signing a piece of paper!?
    I think you just need to put it down to a lesson learnt and hopefully come to an arrangement with the nursery
