And yet they are getting better advice in the motoring section of the forum..

    Amazing eh.

    That being:
8% is the statutory interest rate to which the original claimant (the council) is entitled by law.

    And:
Sorry but driving uninsured is no excuse, imo I hope they throw the book at you !!!:mad:

You had an accident which was partly your fault, you caused damage, now you have to pay.....tough !!!!!

Folks like you wingeing about having to pay make me sick.

    Since nobodies said it yet:

    Think of the kids

Thing is, that advice is actually wrong. The Council is not entitled to the 8% on the value claimed. The MIB is. The Council would have been made whole by the MIB paying out for an uninsured driver.

I'd go to court personally, If you have had no other communications from them and this has come out of the blue I feel the Judge will be lenient.

Sorry. Not sure I follow. OP has clearly said that MIB is the Claimant as he was uninsured.

It's within the 6 year Statute of Limition. You are liable for the cost of the repairs. It's that simple

Go to court, take it on the chin and make an offer based on your income.

I do hope you buy insurance now

    I agree with this.

    All but the highlighted point.

Try to negotiate repayment WITHOUT going to court otherwise your credit report will be effected. As long as your reasonable in your offer of repayment they will likely work with you, otherwise a judge may award a ridiculously low repayment amount which they won't really want.

Why will their credit report be affected - will the court judgement be in the form of a CCJ with the prospect of bailiffs and such like?
