Boundry lane

Hi. I need a bit of advise. Just bought end of taracced property. Could anyone tell me can i move my fence which is attached to house and relocate it to my boundry lane which is aproximetely 2.5 m from house? Plan shows footpath border as my boundry lane. i have phisicly measured it at it is about 2.5m. So would i need a…

Only a court can decide, and the only if someone decides to sue you over it. A surveyor can give a professional opinion.

You logic sounds reasonable - if the line is adjacent to the path your boundary is too as it's the only obvious reference point (assuming the edge of your house or other fixed feature is not suitable either). The only flaw I can see in this is if the width of the path

If I were you, I would move the fence. You can always move it back if the council or other body complains (I'd do that to avoid them taking any expensive action against you, but then in your own time build a legal case to see if you could/should move it back.)
