Boundry lane

Hi. I need a bit of advise. Just bought end of taracced property. Could anyone tell me can i move my fence which is attached to house and relocate it to my boundry lane which is aproximetely 2.5 m from house? Plan shows footpath border as my boundry lane. i have phisicly measured it at it is about 2.5m. So would i need a planing permission to move existing fence or can I do it just like that.... please see attached boundry lane pic. dotted lane is where my egsisting fence is and orange is my boundry.

  • You don't need planning permission to move a boundary fence. What you do need is to be absolutely certain that you know and understand exactly where that boundary is.

    Is there currently a gap then between your fence and the footpath then? What's there?

    Bit unclear of the set-up. I'm assuming by 'boundry lane' you are referring to the line of your boundary? Not to a 'lane' which is yours?
    Also not clear about the footpath - is this on your land or do you mean the footpath beside the lane (which may or may not be yours)?

    Is the footpath a public right of way and if so will you new proposed fence close it off?

    Planning Permission? No.

    But check the ownership of land carefully.

    And check the Right of Way issue carefully.

    And check your Title Deeds for any covenants which might require a fence in a certain place, or NO fence in a certain place, or permission from a freeholder or previous owner etc

    Right to clear things out.

    I mean the footpath beside the lane. There is a footpath on the side as you can see from the picture and line goes along it. It is a poublic footpathm and I want be blocking it off at all. That's how it is market up on Land Registry. I have spoke to land registry services and they can't tell me the dimension from footpath to my wall becouse you can't scale it from the map.

    Should i contact council and ask them about it? or should i go a head and make my garden bigger.

    there is about 2-2.5m gap between a fence and footpath. The Land registry map on my title deeds shows the boundry line up to the edge of footpath

    How can I do that? Tried with Land registry but they can't specify...
