phone contract...help!!!

i am a customer with 3 mobile on contract, but i got a call one day from 3 thinking they was updating my phone...i got the phone and sent to me thinking they was going to turn my other phone off....but they never, it was a new contract, i asked if i could send it back because why would i want 2 contracts, but because id used it (i sent 1 txt) i couldn't and now i have to find somebody for the contract...but i dont know anybody and iv called 3 explaining to them, and one said i could send it back, and then someone said i cant, i keep telling them i cant afford 2 contracts...but they wont budge, its stressing me out because its for 2 years and my phone contract is for 2 years and its £38 a month im paying out for 2 phones
all i want to do is send it back, so all i want to know is do i have the rite to take it further, or am i now just stuck with the phone?

What's the timescale? When did you agree the new contract? Distance selling regs?
But if you've already used the phone you're going to struggle.
The phone is not the issue, you can sell that on-the issue is the 24m airtime contract that comes with it.No free lunch, and no free laptop
