DFS Sofas

Hi really wanting advice re our new DFS sofas purchased 10 days ago-think we are onto a losing battle but just wanted advice before we kiss goodbye nearly 2K!
We purchased 2 sofas from DFS online, we went into our local store and tried out several first. We explained about my dodgy back and that our decission had to take into account this. The very pushy salesman convinced us to buy one we were interested in and told us would do the job and be ideal.
Got it delivered and within 2 hours I could barely move with excruiating back pain! Have put up with my back and thought would just be a case of getting used to however its getting worse and Im onto my 4th Chiripractor session which is losing me even more money!
Dfs dont want anything to do with us, we signed the credit aggreement nothing wrong with sofa and just becasuse my back doesnt agree with new sofa isnt their problem. These sofas have turned into expensive ornaments while i lie on the floor!
We thought that under the sale of goods act we would be entitled to a refund as they are not suitable for purposes intended?
Really stressing me out as know we have lost 2k and are going to be be paying over the next 2 years for sofas I cant use!

To be honest, as you had a chance to test out the sofa when you went in store, I can't see them being responsible for refunding you. They are in no position to offer advice on medical issues, so if you didn't know that it would affect your back this way, there is no way they could have known. Is it possible to modify the sofas to make them more comfortable such as adding a wooden board underneath the cushions to make it firmer or similar?0

I understand what youre saying but I made it clear that I thought the sofas were too deep but they convinced me with all the scatter cushions it wouldnt be a problem.
I didnt go in looking for medical advice simply made them aware of my back problem and how important it was to get the correct sofa!
To be honest with you we tried out the sofas for a couple of minutes so how can anyone tell in that length of time whether they will be suitable.
After spending 2k im very reluctant to have to modify them and expect after spending that amount of money shouldnt have to!0 -
What may suit one person may not suit another so they could not really decide what will and wont fit
your needs.
If you thought the sofa was too deep you should not have bought it, They dont twist your arm for a sale.
Pushy maybe but not physical force. You could have sat on the sofa for a while get them to bring you a cup of tea,
They dont chuck you out after a few minutes.
Looking for a sofa myself and i have asked for a cuppa taken my shoes off and lay on them etc. Spending a lot of money
so i need to make sure its the right one.Censorship Reigns Supreme in Troll City...0 -
the problem is that you tried them instore and then bought online so you can't send them back under DSR
before anyone aruges:
Would the DSRs apply where a consumer has examined
goods in my shop and then orders the same goods from me
via distance means?
2.13 This depends on the circumstances, but we consider the DSRs would
not normally apply where a consumer examines goods at your
premises and later orders those goods by distance means, even if the
goods are slightly different, for example, ordered in a different colour
from those actually examined.0 -
Nice to hear no one on my side!!!0

Yes I understand all this but they are the ones employed as sales people-who are paid to advise the customer so obviously Im going to listen to them!
Dont think I could have asked for cuppa and put my feet up!:rotfl:0 -

Op, unfortunately your on a consumers rights forum asking if you can legally return then as not fit for purpose.. i'm sure nobody wishes you anything but the best, but unfortunately the advise offered is factual and constructive.
Fit for purpose is commonly misinterpreted, since the sofa can still be used as a sofa then it is fit for purpose and you did have ample opportunity to inspect the gods prior to your purchase. Despite what the salesman said, you was able to lay on the sofa and see if it truly would fit your needs.
What you could do is contact the company and ask if they would accept an exchange... although this would be a gesture of goodwill and they may require you to pay delivery and the difference in cost (if any).. it may be your only way forward if your unwilling to make modifications..
By placing cushioning or hatever you need to under the cushion you could solve the problem with minimal effect on the item.
People are just trying to help, but unfortunately will not just tell you what you want to hear.0 -
Thanks but in my case its not fit for purpose.
These companies are quick enough to take your money but stuff the after sales service:mad:0 -
Fit for purpose isn't user specific. Like if you buy a size 8 dress when infact your a size 20, just because the dress doesn't fit you doesn't make it not fit for purpose.
I think the key here is the fact you was able to test and inspect the sofa before committing to purchasing it. The salesman has no way of knowing if you are comfortable on the sofa or not since what one person may find comfortable another will not.
I think you should appeal to their good nature and try exchange it for a more suitable one.0 -

You could have! I was in a DFS store a few weeks back and was offered a cuppa and told to sit on the sofa's as much as wanted and sprawl about in them like I do at home. The man said the most important thing was making sure my bum was happy
When I bought a bed last year, I took my shoes off and lay on the beds for ages before deciding which one to buy. Here I go again on my own....0
