Help.... With getting deposit back from Landlord

Hi All,

My wife and I moved from our rented house in May we moved in Dec 2009 and I went through all the checks with LL everything was fine, but i am still waiting for our deposit i have been resonable( I think) I have rung a number of times and she keeps putting it of with reason that she "cant pay the mortgage and she needs to have people in the house before she can give it back"

I know she has not put our deposit in a deposit scheme all I got was a paper reciept

Can anyone give any advice please

  • Write a Letter Before Action giving the landlady 14 days return it and then go to the small claims court. Do it now
  • I have just checked the contract and I also have no address for the LL just a moibile number should I send the letter to the house that we were renting?

    For about £4 you can check the land registry online to find the owner of the house.
  • Yep, send it to the property address (send two copies by First Class from two different Post Offices retaining proof-of-postage) if you don't want to spend £4 on the Land Registry site. It's entirely possible that if the LR site shows the rental address for the LL they didn't get Consent To Let from their mortgage provider.

  • electoral is availble at the local library?

    just checked on the Land Registry and her registered address is the house i rented

    The electoral roll is available in most main libraries (sometime not this years but previous years).

    Have you actually checked whether the deposit is registered with all three schemes?
