    There is a good reason you've been advised not to cancel the DD, this will have stopped payment but not the contract. If any payment is due and they cannot collect it it may go on your credit file for up to 6 years.

    It you go into arrears then should it go further you will be the one on the defensive for not making payment.

    As your well past the 7 days to return it as a service althougn you havent had the phone under the DSR it could be shakey ground.

    One question is have you not chased where the phone was before now, if I'm reading this right the upgrade happened 4 months ago and your only trying to find out where the phone has gone now?

    I have told orange I am not in contract with them and wish to cancel it from the 1st July so therefore I am within my rights to withheld payment and the direct debit is upfront for August payments which is why I noted that I have sufficient evidence.

    I have told them I am willing to make payments once my contract has been fullfilled.

    I have 7 days in which to cancel from the day I receive the goods (under the distance selling regs). Again I have not authorised the contract to go ahead so therefore I am in a rolling contract at present, the 3rd party have agreed to the contract without my consent so therefore it is fraud.

    Yes I have been chasing this for 4 months since my phone was cut off it has taken all this time to get sorted.
