  • The man in front was adamant that the law stated that as he paid by credit card, he was legally entitled to a cash refund. (ha!!)

Ha indeed, the Rules for VISA merchats (It's a PDF) explicitly state:
Do not provide cash refunds for returned merchandise originally purchased with a Visa card. Visa does not permit cash refunds for any credit or debit card transaction. By issuing credits, you protect your customers from individuals who might fraudulently make a purchase on their Visa account and then return the merchandise for cash.

Always good to know the rules the shop has to play by. Incidentally shops aren't allowed to require a minimum spend or surcharge to pay by credit card.

When I was a retail manager I would write on peoples reciepts that a refund was okay, so I do that now when purchasing items from shops that do not automatically offer refunds.Have put up with some abuse from people wanting to cause a scene and even had to threaten them with phoning the police!

These rules are for US merchants.

For the UK it's the Visa Europe website but the rules are set by acquiring banks. I can imagine it's fine for the above in the UK. This would explain why so many places do it.

Also http://www.visaeurope.com/merchant/acceptance/gettingstarted/findtherightaccount.jsp Say's "Before you sign a contract with an acquiring bank, ask yourself the following questions:...............What are the typical fees for card processing?"

Therefore with a charge being issued to the merchant I can't see why this shouldn't be covered by a minimum spend.
  • she could only have the reduced price as an exchange even though she had the receipt showing the full value as it was outside 30 days

I work in retail and she should only get the reduced price if she doesnt have proof of purchase, providing you have proof of what you paid that is what you should get back. only if you do not have proof of purchase should you get the latest selling price.

as for refunds, you should get the money back in the form it was paid, ie if you paid by cash thats what you get back, if you pay by credit/debit card the money has to go back on the exact card it was purchased on (which causes problems with gifts I know) if it wasnt for so many dishonest people in the world perhaps rules wouldnt be so harsh!
finally debt free and want to keep it that way!!

I personally wouldn't buy goods with a policy such as the OP posted. I expect to return goods for a refund if unsuitable (with receipt) and if the store don't offer this policy, i use an alternative store with a good refund policy!

Yes - but do you ask the store at the time you are making the purchase what their refund policy is?

Leaving aside the refund issue, the woman should not have bought shoes for a growing child without him being there to try them on.

OK, I suppose she wanted to surprise him for Christmas.:D

What you say is common practice but in law it is up to the store to determine refund policy. Customers are not automatically entitled to a refund for goods unless they are faulty or not as described etc.

Quite right. The problems are poor training of staff and improper procedures and lack of knowledge of the law in this area.
Don't bother trying to sue me - I've got no money!
  • I had someone that said they would chain themselves to the chair (in the bank) and someone who said they would be waiting outside at closing (when i wouldn't refund something they'd obviously worn and wanted to return)

I don't get paid enough for that abuse
