They took my money without my say so.

hello, I am in a bit of a predicament. I recently set up a DMP with immediate finance, have started a new job and everything was going fine, then all of a sudden over the past 3 days, one of my creditors (capital finance one) started taking £25 out until my account was empty, taking £400 and I didn't notice until a couple of days later when I checked my account and then contacted the bank. I thought I blocked all out goings from that account and didn't realise that they had my details.

Can I get this money back? I contacted my bank and at first, I spoke to someone who couldn't even speak English very well and he said that it would be refunded, but I rang again later and the woman I spoke to said that here was a possibility that it wouldn't get refunded and I had to speak to my DMP. what do I do???

if it was a card payment and not a direct debit, not much. Close the bank account, open an ne one with a totally different bank.
    Debt free 4th April 2007.
New house. Bigger mortgage. MFWB after I have my buffer cash in place.
  • so they can take money out of my account even though all my outgoings are blocked? I rang the bank and they said it was my debt management plans' responsibility. I find it crazy that a creditor took £400 without my authorization when my debt management plan are supposed to be looking after my finances

  • It was a series of transactions as if I had spent money at a shop-eg, they took £400 out but did it in £25 transactions. They must have my bank details.

So you mean it shows each transaction as a separate card payment, or does each one say 'direct debit to...'? I'd ensure the bank deals with it as fraud.

Have you paid this DMP any money, or is it a DM charity helping you out?

  • I am not sure yet as I am on my online banking statement and it doesn't say as yet. I didn't ask what it actually said when I rang the bank. I tried to tell the bank that this shouldn't occur and they put in a complaint and said it could take 8 weeks to respond! What would the difference be if it was card payment or direct debit? It must be card payments as over 2 days, it was all done separately.

They don't need to take it as a complaint, they need to start fraud investigations as you have not authorised these payments.

As to how, how do you know who has taken it if you can't see it on your statement?

  • I rang the bank and they told me on the phone. Capital finance one took it over and over again-so they could see the transactions but I can't yet.

Ok, so card payments it is.
How long ago did you take this payday loan?
How long ago did your DMP start?
