Old car insurance company initiated cour proceedings against me :-(

    haha yeah lol. I will have to study the case hard to pull it off but i guess i would also get a couple of hundred back from the chargeback also. And i would have to go over my statement to see how these payments were taken. A direct debit indemnity would be amazing. No way am i paying that much for something i never used. Id rather take the ccj although i will fight it all the way. I dont feel its justice for me to pay this.

    It will cost me 300 pounds just to take a day from work and drive 200 miles to the court and back! can i issue a counter claim for this expense?

    You won't have to drive 200 miles to court - if you issue a defence then the case will get transferred to your local court. The claimant will have to travel.

    But if you lose you will have to pay all the court fees plus the claimants costs!
  • You kind of come across as a complete bampot OP.

    Do the decent thing and pay up. You entered into a contract, decided that for some reason you never wanted it any more and just stopped paying. Most companies would have cancelled the agreement for a small fee.

    If you try any of the things you have mentioned on here I hope you get done for fraud as well.

    You obviously have no morals.

    Yes - but before lying; is your bank account, drivers lic, Council Tax at this address

    Bottom line, you verbally agreed the contract, you paid 2 instalments - so acceptance will be implied!
    what about I issue a visa chargeback dispute for service not rendered for the first 2 payments and claim they were taken without my permission as I called up to cancel the policy within the first 7 days and they did not seem to acknowledge this
    Goint to be a bit hard to do and prove 2 years later

    Best to contact them and agree a payment plan rather than going to court and get additional costs
    added on.

    You used 2 months so the contract will stand. I was told an employment contract stands even if you
    dont sign it. Unless you hand it back as working under dispute.

    I cant see any way you could win.

    Yes and it may not just be your own fees. The claimant can file for their expenses to be paid as well.

    Yes. They only have to prove they tried to contact you at the last known address. If you don't turn up, you lose by default.

    Ok thanks your 'some' of your help. Well im not paying! if i lose i will tell the judge to send me to prison. Screw paying for something that i never wanted or used. It is easy for me to claim the 2 payments back as service not rendered and claim i cancelled the insurance but clearly the company still took the payments until i had to cancell them with my bank.

    Then i get my money back and win? ? ?

    And morals? well every man for himself, im sure the insurance company has more money than me. Or should i pay nearly 600 just so i can say im a good citizen?? naaaaaa thankyou, think how many prostertutes i can take advantage of with 600 :-)

    Well thank you very much for posting a question and asking for advice that you had no intention of accepting or considering.

    For what it's worth you may have stood a better chance had you tried the charge back etc after the second payment, give my regards to the judge
