Glad to hear you won't be 'appealing' as that's a complete waste of time and paper. But not bothering to sue them for the money back? That's why these scumbags laugh all the way to the bank at the moment, that's why they get away with their protection racket - because people let them.
Absolute parasites, all of them. People should cut off private clamps at the padlock, then replace the padlock and hand the undamaged piece of rubbish in at a police station as lost property.
Or pay a locksmith to pick the lock instead - I would rather my money went to someone doing an honest job.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I think you would win hands down on this one, clamping is a remedy for trespass. How can they invite you on to land charge you for it, then because your receipt fell off the dash decide you were trespassing?0

I don't think I could win in court as I was actually 20 mins late, my complaint is that they charge so much to remove clamp and when I asked him why he clamped me and not just give me a ticket which was £75 instead of £100 he said it was his choice!0

No they cant have it both ways, they can offer you a contract to park your car for a fee. It is then arguable what they could do if you broke the terms and conditions they assume you agreed to!
Clamping is not a remedy for a breach of contract, it can be used as a deterrent and remedy for trespass.
The reason they clamped you is because you then have to pay, whereas if they ticketed you you could ignore their demands.
As I posted above they cant invite you on to their land then decide because you were 20 mins late you were trespassing. The remedy for that scenario would be for you to but them in the same position they would have been in had you not overstayed. i.e. you owed them for 20 mins parking!0 -

I'm afraid I have to disagree. If there are charges for parking based on the amount of time that is in effect a conditional permission to park.
The condition being that you are only allowed to be parked on the land for the amount of time you have paid for.
Once that time has passed then your permission to park lapses therefore you are trespassing.
Clamping for overstaying is not that uncommon and if it were so simply not allowed I think we would all be aware of that by now.
PS No disrespect intended to the OP but IMO anyone who parks where they see clamping signs must be off their rocker..they'd be better off chancing the double yellow line at least that's only £60 !0 -

Actually 10 mins after I posted that I thought about it and realised technically they could, but I would like to see the signs and terms!
I have to agree with your statement about using the car park with the threat of clamps being used. [Unless I had an angle grinder in me boot]
Specially with this company who do have a bit of a reputation around the south west!0
