But the hotel can now re-sell that day.

Tell me, what's the point of having laws if hotels don't abide by them? It seems to me like you don't know (sic).

The hotel should attempt to re-sell, and should refund the £500 less any costs/losses relevant to the change of booking.

The hotel may well find it difficult to sell the day. Venues will now be booking into 2013, it will probably be a last minute booking at substantially less.

To the OP, this is what your wedding insurance is for. It won't be the only deposit which is not returned and the less stress the better in these circumstances the better.

Ask the venue to re-offer the date, and agree that if they haven't managed to re-sell it in the next 14 months that they can keep the deposit, however if they do manage to re-sell the venue, you'll take the £500 (or maybe £450-odd?)

On the argument that venues are now booking into 2013, I would say a last minute booking could be considerably more.

    Was being sarcastic.

And how will sarcasm help? Good manners cost nothing and will make people more likely to heed any comments you make.

What was the point in replying to that, It's going offtopic, And wasting effort and time to post . Just like this reply is.

To be honest ill say what i like that being sarcastic or the truth, I dont care what other people think of me or my posts.

Worrying about what others think of you will just bring you down.
  • Some pretty ignorant/incorrect posts from some regular members here, quite surprising really!

Optimist and PinkShoes are right on the money. They cannot just retain the full amount even if they have it written in their T&Cs. They have to mitigate their losses and this would mean re-selling the day and given it is 14 months away their losses would be minimal to nothing as I assume they should be able to re-book the day.

Retaining an arbitrary amount such as £500 would be seen as a punitive penalty and hence an invalid term. If it was a genuine pre-estimate of loss (or actual losses they could prove) then it would be ok, but it would be up to them to prove it to a judge.

Ask them nicely one more time, send them a letter before action and then go to the small claims court. They haven't got a hope in hell for more than a couple of hundred quid tops.

Wedding insurance doesn't cover you if you decide not to marry.

i thought if a deposit was non-refundable, then it had to be stated as such? You can put a deposit down for something without being obliged to buy, so I thought.
There's a storm coming, Mr Johnson. You and your friends better batten down the hatches, because when it hits, you're all gonna wonder how you ever thought you could live so large and leave so little for the rest of us.

It doesn't matter what the contract says about whether it is refundable / non-refundable, if the retention of deposit amounts to a financial penalty then it is not allowed to be retained.

your username implies you know something about business but your posts saying other people are on the money suggests otherwise
do you have any idea what costs are involved once the £500 is dropped? do you consider that the OP just dropped into the hotel and dropped 2 halves of a monkey on the reception desk and walked out with no time spent talking to people and probably outside people being booked too after he left
£500 seems a small price to me to walk away from such big obligations
