Yes I am on here having a rant.
It's New Year so haven't been able to talk to the LL, the agent or the Council but rest assured I will be doing so in a business like manner tomorrow. Scumbag seems quite a tame thing to call then if you ask me, I can think of much worse
The intention is clear, build house= make money. This gives us a choice put up with it or move on. Effectively forcing us to leave. That's our view anyway.
thesaint - The agent said they were LL's who buy property to rent out. No mention was made of any pending building projects on the property they were offering for rent.
We signed contract on the 30th, the notice was dated the 27th, we did not visit the house in those three days let alone the planning dept.
They bought the property several months before with the obvious intention of building the new house on the land. They then delayed the actual application to just before we moved in so we wouldn't find out. That's my assumption but a bit of a coincidence timewise don't you think?
Somerset- Can't HA or Council as I earn too much but still can't afford to buy our own property and support a family of four, catch 22.
I don't have a problem with anyone aquiring PP. I mind it when they collude to keep it from me and tell me something else.It's a 12 month AST with a 6 month break clause.
Clutton- I don't think they are going to just tear up the contract. Anyway we still have to live somewhere! We've paid the LA several hundred pounds in moving in fees and handed over several thousand pounds in advance rent and deposit. They won't just give it back.
GG- Did you think telling me off for my bad 'attitude' wasn't being judgemental? Honestly??? Option 1 is what we will have to do.0 -

Talk to the LA and see what they say ........... it is no skin off a LA's nose if they let one house over another house, its all commission for them - particularly if you can prove what you are alleging - how do you know when they bought it and when the PP was applied for ? you don't know any of these things !!!! But none of these things matter in the legality of the AST.
Perhaps one of the grounds for rescinding this contract and asking for another house is that you wanted to rent a house with a garden.
But - if they are not going to start work on the new house till after 6 months, you have no case as you signed the AST for 6 months. Obtaining PP and then finding a builder and starting work can often take longer than 6 months.
Wouldn't it make sense to try to find another house with the LA right now, and not have to move again in 6 months ?
Believe it or not i feel very sympathetic to your position but - as GG has said calling folks names before you have the whole story is not terribly sensible.0 -

I was trying to help. Hopefully you will get the answers that you would like when the offices re-open.
I think that you should double-check your agreement but, if all is well, your LL will not be able to start any works until 12 months are up. You can also leave at 1 month's notice so, if after 6 months your LL will not renew your tenancy with the property being much the same as it is now, you will know that you should find somewhere else. You will have 6 months to find the right place (Jun to Dec).

Property developers are different to Landlords. Of course you can be both but if that is what they call themselves then that is what they are. I have a house on rent, so I am a landlord(part time) but would never call myself a property developer.Well life is harsh, hug me don't reject me.0 -

You have the choice, imagine if you had just bought and found your neighbour was planning on developing, there would be fewer options for you.The agent said they were LL's who buy property to rent out.No mention was made of any pending building projects on the property they were offering for rent.

My only concern for you is that you will be able to enjoy the whole of the garden during your tenancy and not be restricted to part of it. I hope your AST makes that clear. Providing it does, I doubt building will actually start imminently. We don't use the garage at the side of the house as the LA said the LL wanted to use it for storage. It now occurs to me they want it kept empty so they can demolish it and start laying foundations without needing our permission. Deceitful.0

Possible but possibly not. speak to them in the morning, find out the truth and let us know. You are entitled to quiet enjoyment of your home.
Worst case - you are tied in for 6 months and are then free to move on - a little wiser.
Best case - planning application gets refused.
If the LL had wanted to be deceitful, the planning application would have been submitted after you moved in.
I like conspiracy theories but I find that those relating to Diana's death and the American moon landing of 1969 slightly more credible.

I have one BTL and my tenants can stay as long as they wish. However, I can only ever offer a maximum of a two-year tenancy. I'll be offering gas central heating to replace the night storage heaters this summer. This will cost me £000's but my tenants will not be paying a penny. Of course, I'll be doing this solely for my benefit!
