Bought child’s mattress question?

I bought a child’s mattress in May 2011, my under one hasn’t slept on it, but the mattress has changed colour and marks have appeared on it. It was top of the range in the shop!

I have the heard on the radio recently, if a product is bought and becomes damaged with no fault of the customer and the product is less than 6 months old, then I could return it to the shop. This is because the product is not fit of its purpose.

I can’t let my under one sleep on it, as it would damage his health, etc. I had to throw away the previous one, which I bought for my first child, and buying a new one for the second for new born.

I will be obviously, go to the shop and talk to the staff, but if they say “NO”, then what steps can I take and the companies I need to contact?

The shop was an independent, not a chain store.

    I cant see how you can conclude sleeping on an item which has changed colour or has a stain on will ruin your childs health. It could be something as simple as sunlight damage or equivalent.

    I think the assumption its a health risk is really quite far fetched without suitable evidence

    Have you had an independent assessment from someone qualified to advise on matresses and health? Maybe the public health people at the local council can advise?

    Is it an all foam mattress? If so foam does and will change colour.

    How will it damage the health of your child?

    Mattress will NOT be deemed unfit for purpose just because it's changed colour.

    As Pinky has mentioned if it is a foam mattress it will discolour as it gets older. Also where has it been stored, has it been left somewhere where it could have got damp or stored in direct sunlight?
