Fraud HBOS

At the beginning of this month I had several fraudulent payments made to an insurance company, I contacted HBOS, all payments were accepted as fraud, my card was stopped, a new one issued and the money was restored to my account by the end of the day. Excellent!

Until yesterday when another letter landed on my doorstep telling me I was overdrawn. The only payment listed was to the same insurance company as the previous fraud. Only this time it was using my NEW card details. How is that possible? I'd not even had my new card 2 weeks! It has left my purse only twice - once in a shop and once online. My antivirus software says system secure.

Anyway, because this is a second fraud claim on a new card, HBOS won't restore funds immediately. I am now left with no access to any money, and feeling extremely vulnerable.

Does anyone have any advice, or had anything similar happen?

    Let HBOS carry out there fraud investigation and if I were you I would contact the insurance firm and ask them what the hell they are playing at and also to arrange an immediate credit back to your account for any monies taken if they fail to act as per your wishes tell them you will take them to Court, and also seek any other cost's involved and damages !

    Were the payments made by Direct Debit or taken from a debit card ?

    all were by debit. we did call the insurance company, who have no record of my name. I just want to know how anyone could have found out my new card number in such a short space of time!

    My guess is that it was a continuous card authority, they debited the old card and HBOS transferred it to the new card. HBOS are pretty incompetent after all, pretty much on a par with Santander, so anything is possible. A friend of mine had similar problems and let's just say that they no longer bank with HBOS.

    the insurance firm is shown on statements as 'Yes Insurance' and all payments have been taken from a debit card (not direct debit)

    Then you should write to Yes Insurance full details here : http://www.yesinsurance.co.uk/contact-us.html

    Enclose a copy of the statement and a covering letter with words to this effect.

    Dear Sir's

    Please see attatched statement regarding monies taken from my account without my knowledge nor agreement, this is not the first time and previously I had to cancel my debit card because of the fraudulent transactions your Company deemed it nessarcery to take without my consent.

    I require a full refund for all monies taken together with an explanation as to why you are seeking this from myself, I will give you 7 working days from date of letter to reimburse the funds in full together with any additional cost's incurred from your unlawful transactions.

    Failiure to comply with my request will result in the following measures, report you to the FSA, FOS and any other Governing Body that can and will carry out intrusive, time consuming and possibly costly investigations, furthermore I will also issue your Company a Small Court Claim seeking the full return of all Monies taken together with any additional cost's incurred.

    I await your speedy response and resolution regarding the said matter.

    They will have been set up on what is called a "Recurring Card Authorisation" - this means the insurance company doesn't need new card details to continue claiming against it.

    Yes Insurance should have a fraud team. This fraud team should be able to take your old VISA card number and link it with an account; and mark that account as fraudulent. If they don't; send them a formal written complaint and take it to their ombudsman.

    I am going back to the bank today to see the manager and will mention the 'recurring card authorisation' (never heard of this before, but it sounds like a dirty filthy way to get money out of people)
    Hopefully I'll have something sorted, I'll post an update later on today.

    (I have to say this RCA thing does sound a more plausible idea than what my parents suggested - that either my computer had been hacked or there was a dirty rat doing it from within halifax)

    Or it may simply be that you had, once upon a time, held a policy with the Yes Insurance's underwriters (many insurance brands use the same underwriters) and a computer glitch set up the payments against the wrong card details held on file...
