Help ! Unemployed as of today !

Hello.

In a world of trouble as of today so here is the story.

On the 20th of June I was asked to attend an interview for a mobile security job based in Chester. The interview went well and they got me to fill in a lot of forms and even filled in and signed the 48hour week form (which they wrote 60 hours)which I thought was strange for an interview. They told me the job would be based in Chester and I would cover the Cheshire area which was great.
4 days later I received a call to say I was successful and I stated I needed to give my current employer g4s 4 weeks notice which they said to do. I resigned on the 27th of June from g4s as requested which my new firm said was ideal as the new job didn't start till the 1St of Aug. roughly 2 weeks later I was told that I was needed on the 25th,26th and 27th for a training course which I was looking forward to.
Yesterday was my last day at g4s and today I awoke to a phone call from the guy who interviewed me to say his boss has decided to take the Chester car away from them and there is now NO job in Chester, apparently the area is now being covered by the Widnes base which they already have 2 guys for !..he said the only thing he could offer is a job in Manchester which is around 100miles round trip and considering the Chester job i applied for is only 11miles away (living on the Wirral) this is simply no good !
So to put it bluntly I've just given up a full time job in order to take a job that suited me better travel wise and now 1 week before I'm due to start the Chester job that was advertised is no longer there and the best they can offer me is something with a 100miles round trip and tbh i can't even trust that this job is there now after this!. I would never have applied for a job in Manchester and this simply can't be right for them to do this knowing I am now effectively unemployed!.
I do not have copies of the forms I signed but verbally they promised what I have stated.
Does anyone have an idea where I stand here as I don't know where to start now?

Thanks in advance.

Should have waited for written confirmation(although not much help anyway) but whats done is done. Someone more knowledgeable will be along soon.

as far as i can see even with written confirmation or a contract you would be unable to do anything as the company could have in theory got rid of you for any reason within the forst 12 months. Can you not have a word with your previous boss to see if they will take you back?

I would agree - and the company are not even obliged to pay notice as the contract does not start until August, so they have given more than any required notice (which is nil in the first month unless a contract says otherwise). I am afraid your only option is to see if your employer will take you back.

Already replaced me in my old job, Job isn't there any more, they got me to sign the contract in the interview as they said it "saves me coming back" so they have the only copy, seems wrong that they can advertise a job takes someone on and is never actually there. Cheers for the responses.

So what you're saying then John is that there is absolutely nothing i can do to safe guard this happening again and you are totally at the mercy of the new firm and this could quite easily happen again and to anyone and the employee ends up in a world of trouble and unemployed?

    Yes.

A contract did exist - because you had accepted an offer, even verbally. However, as an employer can sack you for any reason (except a discriminatory one) in the first 12 months, as long as they give you notice, you can be let go. In this case, you're effectively being given notice before you've even started.

Similarly, if I accept a job verbally, then change my mind, legally I have to give notice to that (even if I haven't started the job). In reality, the employer would just cut their losses and offer the job to the next person, and nothing actually happens.

I am very sorry for you, though - and a written contract or confirmation would have made no difference, so there was nothing more you could have done. I really hope you manage to get something soon.

' <-- See that? It's called an apostrophe. It does not mean "hey, look out, here comes an S".
  • As a safeguard, ring up the Jobcentre and make a claim for Jobseekers Allowance to get the ball rolling with them. Hopefully, you'll find yourself in a better position, but it's always good to have a backup ticking away in the background for worst case.
