Car warenty
On the 01/12/2011 I bought a Mitsubishi L200 Diamond 57 plate car for my business. I had had the car just over 6 months, when I was on a trip back from Carlisle. The car was in cruise control, it had no load inside or towing, just 2 passengers. I was cruising at 70mph and I got to within 30 miles of home on a 3 ½ hour trip. The car started to show signs of heating up by the temperature gauge rising on hills in road and dropping again on flats. It’s worth noting never did the gauge hit the top of the scale and neither did any light or noise indicate there was a problem. Just as the driver I notice the gauge rise and fall from about half way up to about ¾ the way to the top.
The car then out completely. I drifted onto the hard shoulder and called the AA. I got home 7 hours later.
My car got towed to my local Mitsubishi dealer, where I had purchased the car from 6 months earlier. It was due, and booked in for a service the very day it arrived there. They inspected it and got back to me within a day to tell me that the engine had over heated, they couldn’t tell the extent of the damage without removing the head, and asked for permission to remove it. I gave permission, and then although calling the dealer twice to five times every day, the only reply I got was that they were waiting for Mitsubishi warranty to give the go ahead for repairs.
2 weeks later and still no car, no replacement and no offer I had a call from Mitsubishi saying the extent of the damage was £12,500??? On a car I bought 6 months ago for £13,000 (£8,000 plus my old car) I was staggered. They said they were liable and would pay £9,500, but the extent of the damage was so bad that they felt driver damage caused by driving the car after it should of been stopped caused over £3000 damage. They did tell me that I could contest it, but warned me this would not only prolong the repair, but also it had been to every department in Mitsubishi and been thrown back, so chances were very slim.
They had me over a barrel here, as they had my car, now for nearly a month still nothing started on repairs, no replacement offered (apparently not in the warranty). But I had a family holiday booked for 2 weeks time and I needed my car, so I agreed to pay it and now as I write repairs are taking place, and I have 6 days before I leave for my holiday, still keeping my fingers crossed I have a car.
I feel having bought a car 6 months ago, under warranty from a Mitsubishi dealer, the car cuts out, no warnings at all (Even though this cannot be proved), and all of a sudden a car worth £13,000 now has a repair bill of £12,500??? Of which some I have to pay???. Not only this was a business car, They gave me no replacement, so I had NO car for a month. My children had to be delivered home by their child care (at extra cost), I had paid Tax and insurance on the vehicle for a month unused. And my own business could not function properly with no truck. This coupled with the fact I have to hope I get my car back in time for our family holiday, then risk the repairs driving to south France in it.
I’m not sure If I should be paying (as of yet I haven’t, but I have agreed to so work can start on my car). I’m not sure if I can now contest the claim or get any money back. But any help or advice would be gratefully received.

What I'd be asking is what exactly is costing £12,500 as this sounds far too excessive for what should amount to an egine swap? If the fuel pump and turbo were shot that could add a chunk but even so I'd be interested in a break down of the planned work. I don't see how they can not cover the whole cost, if they felt they were not liable in anyway then why are they paying x amount. I've never come across tis scenario before with a manufacture warranty of a part and part settlement.0

I know an engine is these can run to £9k + but I wonder whether the dealer is being crafty and trying to recoup some of it's costs from you? they will only gwt paid warranty rates by Mitsubishi so I would definately ask for a breakdown of costs including the percentage Mitsubushi are paying.
Have you checked the warranty claim limit - I'm presuming it's an extended or aftermarket warranty sold by the dealer as the 3 year manufacturer warranty has expired?
It's not impossible that they are only offering to pay a percentage towards the repair as a 'goodwill' gesture but you deinately need to find out why they appear to accepting most of the blame - it's all or nothing imo if it's nder warranty.
I don't think any warranty will cover loss of use or hire car, that's the risk we all take when a mechanical marvel such as a modern car that we rely on breaks down!
Am I being harsh in suggesting that you could/should have stopped the first time the gauge went up above normal? it may well have been too late by then but...
I know on some cars the ECU will record the highest temperature reached and other info - might be worth asking the dealer ?0 -
Thanks for your help. Sorry about paragraphs etc. I sent the same message to lots of places, so I typed it in word (with spaces, paragraphs etc) but when I copied and pasted here and posted they were removed.
In hinesight I should have stopped when the heat gauge went up, but on the M6 there isnt too many places to stop.
When I spoke to Mitsubishi (Not the dealer, the warrenty people) They said under test they couldn't get the parts that melted and over heated to do it under tests, therefore they put it down to driver.
They offered a breakdown of parts replaced and covered, and also said I could contest it, but this would further hold up the repair. They have me over a barrel here really as I need it in 5 days now to go on holiday. They are replacing the Turbo as good will as they said there was no proof it was damaged, however as everything else is being replaced there is a good chance it is damaged and so will replace it as well.0
