I like your analogy RobBob and think I'll quote that when I write to Card Services although mine was a Debit Card it still comes under the Visa banner and according to all the experts on TV etc, one has similiar rights to those of a Visa Credit etc.
Not only do I intend claiming back all the Bank charges incurred, I will claim back the charges incurred by paying a credit bill late and my prompt payment rebate on my gas bill plus the costs in respect of my time and telephone calls.
Anyone one got any ideas where I can go to find the exact position legally on the use of Visa Debit/Credit cards so I can blast Lloyds Card Services.
Off to find myself a good pitch - a bit of busking is in order - then off to Tescos with the proceeds!!!!!!0 -

About a year ago I ordered a mail order car part, I gave them my debit card details over the phone, the thing arrived 2 days later than promissed and was not the right thing which i discovered when I broke it trying to fit it.
When I checked my bank statement they had charged me for the part they supplied (£35) rather than the part i ordered (£22).
After trying to communicate with the retailer I thought the money was lost, but thought I would at least give it a whirl, I reported it to the bank and reported the £13 as unauthorised (i.e. I authorised the transaction but not the amount), which I would have thought was a greyer area than your case.
After filling in a few forms confirming details of the transaction, the bank immediately refunded the whole ammount and told me they would investigate it and get back to me.
As I said I'm not an expert but my line of business does allow me to a have a little insight into what happens next, it is the retailers burden to prove that you authorised this transaction.
Eventually the retailer was resigned to the fact that they could not prove I had authorised that ammount so I got the whole lot back
- I omly ever expected the over charged amount !!
Whatever the legality I think both parties could have been more helpfull -
I would write to both the Bank & the Mortgage Company Customer Service departments and state any costs incurred (don't forget loss of interest, telephone call costs & your time).0 -
unfortunately a debit card does not have exactly the same 'chargeback rights' as a credit card. Alot of the rights are the same, but not all. Unfortunately I can not tell you off hand what the differences are, but im sure you have rights regarding this type of transaction.
To be honest, the quickest and easy way would be if you can get the morgage company to admit their mistake and make the refund as they said they would. Otherwise the steps you willhave to take, is put your dispute in writing to your debit card provider disputing the transaction, and advising them that you did not authorise this transaction. They in turn would write to the Company and ask them to provide proof that you authorised them to take this amount from your account. They of course cant and therefore the amount would be charged back.. Unfortunately this can take time and the company will have quite a few days in which they can respond ( sorry not sure how many it is). The bank 'may' refund the amount whilst it is being investigated, but I think it depends on the reason for disputing it.
Im also think you would have to take up any claims for compensation with the company direct rather than the bank,as technically the bank havent made a mistake by accepting the transacion. - I could be wrong here, but thats my gut feeling of the situation.
Sorry if im being a bit vague with some of my answers , to find out the actual rules, their are specific Card scheme regulations but not sure if they are available to the general public and they are a pretty heavy read !
Yes, I do work for a credit card company, although disputed transactions / chargeback rights, arent really my thing. im back in the office on wednesday, and if you are still struggling to get this sorted, I will try and make a couple of phonecalls to the relevant dept to ask their opinion ( and no I dont work for LLoyds - honest lol !!)

30 days. regardless of what the company t and c's say, visa would give them 30 days
bank may make a deposit to 'cover' you while being investigated, but no obligation to do so and probably just a token amount if anything. no obligation thoughIm also think you would have to take up any claims for compensation with the company direct rather than the bank,as technically the bank havent made a mistake by accepting the transacion. - I could be wrong here, but thats my gut feeling of the situation.

correct lisa. again no obligation on the bank. company made the error, they should pay. the bank only accepted an item which the company said was due.

Thanks everyone - Mortgage Company have admitted that they put my Debit Card Details on someone else Mortgage Account - so I paid their Mortgage as well as my own. However if I put in a claim for the additional costs with proof then they will consider it but not to expect an immediate response. !!!!
The monies arrived back into my AC today - so I've been without them for a week. Now paid the overdue CC bill and gas bill but I will claim the loss of the prompt payment discount and the CC late payment fee.
Someone's stupid little error and it has such a knockon effect. Mind you can't fully blame the individual as I feel that they should have been a proper fail safe in place. Afterall they will not let you use a Debit Card that is not in the name of the Mortgagee but uses a system that permits any entry.0
