Help! Paid using Visa Debit - Unauthorised sum taken.

I pay my Mortgage every month simply by Visa Debit. The sum varies slightly each month and so I simply contact them by phone - ascertain the amount and give my card no - worked well up til now. Previously I paid by Direct Debit but found that they were actually taking the money a month early and I wasn't getting the interest.

Just got online to pay my Credit Card bill due in 4 days plus my Gas bill to get the rebate for paying promptly to find my account overdrawn. It appears that the Mortgage Co has taken 2 seperate amount one being the authorised payment as normal plus another amount for £300 plus.

Obviously I will in contact first thing in the morning but before I do - I really need to know where I stand. Can anyone help!

  • have they actually debited the money or is it pending? if its just pending you may find they have realised their mistake and sent a reversal already but this might take a day or two to show.


    if they have debited it they will arrange for it to be recredited to your account. explain to them you are going to be late with various payments and they will refund those charges - although maybe not until you supply them with copy statements.

    Also, call the bank ASAP!! They will be a lot more helpful if you contact them straight away, than if you wait.

    Thanks guys - contacted bank first thing - put htru to card services - advised that as I already do business with the Mortgage Co it is not a fraudelent claim - unauthorised yes - therefore they can do nothing - contact Mortgage Co. Which I do as soon as they are open. Their response - the unauthorised amount has not been credited to my Mortgage Account - so they haven't taken it. The Bank confirms that you have. Well the Bank needs to write to us with the evidence and we will investigate. Contact Card Services again - no we can't do that - contact your branch - their response you have to write with a copy of your statement. My statement does not show who claimed the payment. I just spent 2 hours going around in circles. Meanwhile I am overdrawn - can't use my bank ac to pay due bills or even do the shopping until either it is sorted out or my salary is paid in at the end of the month.
  • is it same bank as mortgage provider?

    if it is get back on to them and tell them to sort it. this is out of order.

    if it isnt. get a fax number for your banks authorisation dept and get the mortgage company to fax them saying they have only claimed one payment of £xxx on xx date

    bank should then refund the unauthorised debit.

    you dont have to write to them, they are jsut fobbing you off

    How can you be sure WHO has taken £300 plus??? :confused:

    Thanks for your support guys. The Mortgage Co is different to my Bank. However the Bank have confirmed that the authorised payment as been claimed by the same person as the unauthorised payment so with the Mortgage Co stating that they have claimed the authorised amount - then it can be shown that they have also claimed the unauthorised amount.

    I have now managed to get the bank to fax the Co to confirm that they have taken 2 seperate amounts from my account on the same day. Still waiting to hear from both bank and mortgage co.
  • It maybe worth re-considering whether to go back to paying by direct debit.

    At least with the direct debit guarantee it would be easier to get the money back if a similar thing happened again.

    Yes I have certainly learnt a lesson, if you have given your Visa Debit to any Company in the past then you are on your own if they have taken an unauthorised payment so in essence you are not afforded the same rights as using a Visa Credit Card well that is what Lloyds are suggesting. In future I will make my payments online at the end of each month.

    Update, the Mortgage Company admitted that they had accidently used my card details to pay someone else's Mortgage and would refund the monies immediately and it would show in my Bank Account today. Guess what it hasn't - probably refunded to the account of the person whose Mortgage I paid this month!!! The Mortgage Company in question is THE MORTGAGE BUSINESS and the Bank is LLoyds TSB.

    Meanwhile any food parcels most welcome - 2 teenagers and a cat to feed!

    Be harder on your bank. Your position is that this is a fraudulent transaction even if it is using details from a transaction which was not fraudulent. The analogy is that you buy petrol at a petrol station once – and they put a bill through every day for the next year – it is clearly fraudulent right?

    AOL charged me the month after I cancelled – I reported this as fraudulent (the email I sent to AOL was evidence of knowledge they had no right to charge it) – why should I have to ring AOL to sort it out? Capital One sorted it all out.

    Have you incurred bank charges because of this? If so I would fight hard with the mortgage company to refund them to you.
