Faulty item bought over the internet and refund

So I bought this USB Flash drive on 15.06.2011, received it the next day, but after time it got corrupted so I open a RMA case on 18.07.2011
Now the online seller claims they can only send me a replacement, but a refund. Is that true?
And when I asked if they will pay my postage costs back they forgot to answer that question  - but I'm pretty sure they are required by law to do so, right?

Do you mean "but NOT a refund"?
Have you already posted back the faulty item as part of the RMA process? If yes then they're obliged to refund your postage costs. (To my knowledge). If not then what postage costs are you expecting to be refunded?
As regards offering a replacement, I think they're within their legal rights to do so - you wanted the item in the first place, it broke, they accept it broke and will replace. Seems fine to me, but I'll let others more clued up than me confirm.0 -
Yes, sorry. I meant but not a refund.
I haven't posted it yet, but my question was about the refund of postage costs back when I do.
The thing is I bought another one online and that is why I would like a refund, but if they are within their rights then I'll just accept the replacement I guess.0 -
replace, repair or refund - entirely the choice of the retailer and not open to your personal preference.0

Not entirely true. After a reasonable time has passed the retailer only has to repair replace or refund yes. However the customer can request one method over another BUT the retailer can refuse IF it is disproportionately costly. You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0
