I'm a tenant being evicted - need some advice please!

    There is a rule about supplying a UK address if living overseas, can you check if Jersey counts?

    No inventory, almost impossible for LL to deduct anything that the scheme will agree to, apart from arrears.

    Council take different attitudes to homelessness. Some regard anyone evicted for rent arrears or leaving before the bailiffs arrive to be intentionally homeless. Others regard anyone served notice to be homeless. At the moment you can just sit tight and she cannot remove you from the property. She has to go to court and if you then refuse to more, get bailiffs to remove you.

    So you can sit tight for now but make sure you inform the housing office of every change in the situation.

    Has your support worker advised you what accomodation you would get if made homeless? B&B, hostel?

    we have no arrears, rent has always been paid in advance, and is paid up until the end of the month.

    we have received homeless status from the council and they have deemed us as unintentionally homeless as the eviction is through no fault of our own, and we are doing all we can to help ourselves.

    we are on housing association and council housing lists, but houses are few and far between. They have assured us we will have a roof over our heads, and they dont like to put larger families into hostels or B&B's - they were talking today of a scheme where the council rent ta private property for 2 years on your behalf? i need to find more out about this though.

    Probably going to get flamed for saying this but I'm going to anyway...

    Why don't you just move out and give the woman her house back?

    She advised you 8 months ago she wanted her house back. She has no obligation to house you and your family, yet you write the post as though you feel you have a 'right' to be there?!?

    How would you feel if the situation was reversed and you owned a property that you needed to sell/live in yourself and the tennants refused to move out.

    It seems to me, as you have had 8 months warning, that if you'd have put half as much effort into finding somewhere else to live as you seemingly have in trying to find ways to stay in the property and cause trouble for the landlord then you wouldn't find yourself in the situation you do now.

    And where do you suggest the OP moves to, given that she has stated that she cannot find an alternative let?

    If being evicted is the only way of being rehoused and keeping a roof over her childrens head's I can't see she has much choice.

    I havent moved out as my tenancy didnt expire until june, and like i said, we have tried and tried for private lets, but landlords are in a position to be picky!

    Do you expect me to live in a tent?

    No, I don't expect you to live in a tent. But I'm also fairly sure our government in this day and age do not let families of 6 end up on the streets.

    What has you difficulty been in finding a private rental property?

    Like I said, I'm just trying to see the situation from a different perspective. It's very unfortunate that you and your family find yourselves in this situation but ultimately it is not your landlord's responsibility or obligation to house you, and like I said you seem to have had months of warning that this was going to happen yet all you seem interested in finding out is how you can stay in the property or cause additional trouble for your landlord.

    I daresay if the coin was flipped and your landlord had come on here posting that they were desperate to regain occupancy of their property and had tennants that were refusing to leave everyone would be up in arms.

    You stated that one of your landlords reasons for eviction was that they needed to live in the property. How are we to know whether the landlord themselves may have a family who are also facing homelessness because you refuse to leave their property?

    Anyhow, like I said, I knew I'd get flamed for saying it, but we're all entitled to our opinions and I bet I wasn't the only one thinking it.

    She did indeed have an obligation to house the OP and her family, until a valid section 21 notice was served.

    Once a notice is served, it's only a notice of intention, not an eviction notice.

    The OP had and continues to have an absolute right to occupy.
