I think you're on a hiding to nothing unfortunately. How can ticketmaster know that you didn't go to the event? Had you contacted them on the day, they might have been able to arrange something with the venue. As it is, all they have is your word that you didn't get them.

This is why I always tell my kids when I've booked something. They make sure I don't forget!

I guess it's not the money that's annoying you. It's cos you didn't get to surprise your family. And that must be awful, and I really feel for you. I've been in a similar situation years ago and it still stings when I think about it.

But BGT will be back next year. And you still have X-Factor and Dancing on Ice tours! :)

It should be relatively easy for the venue to determine whether these tickets were presented for the show?

Had the tickets not arrived then I'm sure that Ticketmaster would have arranged for you to call into the Box Office prior to the event. It was your responsibility to notify them of any non-arrival prior to the event.

A couple of years back I was due to go to a concert and knew I had received the tickets but had misplaced them. I honestly thought it was a lost cause but Ticketmaster and the venue made arrangements for me to call at the box office for replacements on the night.

I would put this down to experience I'm afraid!!

Tickets for some events have barcodes on and are scanned on the way in so you keep the entire ticket instead of having the stub torn off, especially with events at larger venues. Might be worth finding out if that was the case as this event as then they should know whether these particular tickets in question were scanned or not.

As I see it, the OP entered into a contract with Ticketmaster to supply (via post) tickets to the event. Ticketmaster did not fulfil the contract.

Unless it is written in the terms and conditions agreed when purchasing the tickets (not the help page) that the OP must contact them if they have not received tickets, then the OP has done nothing wrong and is entitled to a full refund.

The contract was for tickets to enable the OP see the show, not just for tickets.

The Ts & Cs (AND the booking confirmation) clearly state that if the tickets have not arrived then Ticketmaster should be contacted. They WILL then arrange some other method of entry to the event.
If they do not receive notification of non arrival of the tickets before the event then the recipient has no recourse - HE broke the Ts & Cs.

I used to work at various arenas. Each event, the ticket stubs collected by the stewards on the door are KEPT and given to the box office staff and they process them there to determine which customers did and did not turn up. As such, you can easily prove that you did not go.

But who is to say that the OP had received the tickets, changed their mind about wanting to go and just didn't bother to turn up and would now like a refund?

Exactly. Proving that the tickets weren't used doesn't prove anything

but on the balace of probabilities this would strengthen the OP's claim that they did not recieve them
ultimately though I do not think there is anything you can do OP by virtue of the fact that you did not contact them to say that you had not recieved them - its true that you ordered them a while ago, but most people "look forward" to events they bought tickets for so it is fresh in their mind and they would be phoning ticketmaster to see where their tickets are. the fact that you waited til after the show to do so will to them show that you did not alert them to you not having recieved your tickets, and theres nothing they can do after the show.

Or alternatively, if the tickets got diverted somehow, it could turn out they WERE used.
