Problem with Housing Association tenants next door

    This HA doesnt begin with a P does it? Just sounds familar to another case Ive dealt with in the past.

    This is simply a HA refusing to accept responsibilty for its tenants. whether the tenant is in prison and has someone 'caretaking' or not, they-the caretakers- still have to abide by the terms of the tenancy agreement.

    Its amazing really that you can commit a crime and expect your property avaliable to you when you are released,regardless of the lenght of sentence.

  • I'd phone the benefit fraud hotline. if Housing benefit is being paid on the flat then that ends when he went into prison.

    You'd be suprised by the number of prisoners who get a friend to sign-on for them and collect their benefit. Nice wee nest-egg when they are released.

    Other points are; breeching multi occupancy is breech of tenancy, council tax fraud etc.

    Can't believe this is allowed to happen. A family friend lived with his dad for several years. Glasgow HA took him to court to get evicition after his dad died, sazid he had NO RIGHT to stay in the house.

    Continue to keep records of incidents/ dates and times of noise etc
    Contact Env Health re: noise
    Contact your local council's community safety partnership
    Encourage your other neighbours to keep complaining to housing department at HA
    Ask HA for copy of their Anti social behaviour procedure
    Report incidents to local police regularly
    Submit a formal written complaint to HA, about their failure to deal with the ASB. Follow this through their procedure, usually a few stages before you can go to housing ombudsman.
    See CAB for advice too, I believe if an assured tenant stops using their home as their main/principal home it's no longer an assured tenancy and HA could serve Notice to Quit to regain possession of property, through courts if necessary. (don't quote me on this though, CAB may be able to check/advise). They wouldn't even need to use ASB which is more difficult grounds to get property back on.
