To the OP don't waste your time, energy and possibly money making any legal case. Ok in money terms you are a week short of contractural notice, whats that then circa £500 max? If your were talking about sizeable amounts of money then that would be different. Take the money, glowing reference, all your contacts and as others have said move on with your life.

Couldn't agree more, I suspect that in the not too distant future they will have someone back in this role.

However, if she puts in an appeal or a lawyers letter they may withold the redundancy payment (unless already paid) - unlike the PILON they do not have to pay this.

Either way I would be tempted to stick in a claim. Poor behaviour by the company.

Nothing to stop her dealing with the internal appeal herself (going thru the motions I suspect) taking the money, and then putting in a claim any time up to 3 months after her dismissal.

To answer the points of others saying it is not worth it, she will also get some compensation for future losses, as long as she has tried to mitigate her loss as always.
  • But surely, whether or not entitled to a formal redundancy package, the OP is entitled to payment in lieu of a month's notice? Plus any untaken holiday pay?

Holiday pay yes, but why would she be entitled to a month's pay in lieu of notice?

There may have been a contractual redundancy scheme which kicked in with one year's service (or less). We don't know but, given the short notice period, I suspect not.

Statutory notice for someone with less than two years' service is one week. The OP has not suggested that there was any entitlement to longer notice.

OP might also have taken more holiday than accrued and there might be a contractual right to reclaim any over-payment.
  • ok, thanks.

I'd let it lie if it was me. You're getting 2 weeks pay plus notice, a glowing reference and a good reason to have left your job.
Compare that to putting in an appeal and potentially being taken back on when they realise you are not going to play ball, and in the near future being dismissed on the grounds of poor performance.
Which do you feel yourself is more conducive to your future career?
