Phones4U advice please....

My brother renewed his O2 contract through Phones4U last week over the telephone. The advisor he spoke to told him he uses on average 599mb of data a month & suggested a tariff to suit his need with an iphone 4. It has now transpired that the tariff he was sold does not suit his needs as it only has 500mb of inclusive data. The phone has arrived, but he hasnt opened it, & has instead requested to return it to Phones4U under DSR as he feels he was mis-sold the contract under the pretence it suited his needs. They've told him DSR don't apply to upgrades. Having spoken to O2, they've said if the contract were taken directly through them they would allow it to be returned within 14 days. Where does he stand on this? Can anyone offer any advice please?

Strictly speaking they are correct DSR's don't cover upgrades ...However misselling is a different issue.
If your brother was made aware that the contract was for 500mb then it would be difficult to contest it .....But if he was told it was going to be above 500 then it is a clear case and he needs to refer them to the sales recording and insist it is returned.It's not just about the money0 -

Well they've not let him cancel the contract, but they're sending him a cheque for £84 so he can add a bolt on with O2 for extra data (the cheque is to cover the cost of this over the contract period at £7 a month) & another cheque for £41 to cover the 1st months line rental.
