Legally - I have no idea. I'm sureone a little more knowledgable will be along shortly.
Call the company and explain the situation and take it from there. They may even allow you to keep the more expensive item. What was the item? What is the difference in price between the item you ordered and the item you received? what store was it??
Personally I would keep schtum and wait to see if they contacted me then play dumb! Been smoke free for 4 years!! :beer:0 -
Its not unsolicited. You should inform them you have wrongly received it. You never know, if theres not much difference in price they may tell you to keep the more expensive one rather than pay for its return and then pay for the cost of shipping the less expensive one.You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0

It was quite a bit more expensive - but i just wondered as its their fault for sending the wrong item am i entitled to keep it or legally required to send it back if they want it back? (which i suspect they will)0

I don't believe your legally required to send it back, but must reasonably allow them to have it collected.0

It was an error and as stated if the difference is not that big they may write it off, if on the other hand we are talking about a few hundred pound then they will probably ask for it back and you will have to either accept and return the item in place for the one originaly ordered or offer them the difference, you will not be allowed to keep it if they take this further.0

Contact the company concerned (in writing - email or letter) informing them of their mistake and what they would like to do to correct the situation.
You will be required to keep the item in reasonable condition pending a decision.
If they decide they want it back, then it will be their responsibility to collect it (i.e. no cost to you) and then either refund you or supply the correct item that you ordered.
They may also offer for you to keep it as a goodwill gesture (but I assume they would also have the right to ask for the difference in price if they wish)“That old law about 'an eye for an eye' leaves everybody blind. The time is always right to do the right thing.”0
