Don't be intimidated by all the letters they send threatening court and raising the "fine", because court will never happen.
In the incredibly remote case that it does, they would not have a leg to stand on. I have only ever heard of one case where the PPC won, and that was in a small claims court where the judge was talking out his !!!!, the issue of unfair penalties was not even mentioned, and many believe it to be a set-up.
The law is pretty clear that a private citizen/company cannot impose a penalty on another. No case law or statute has developed which cancels out this rule, so it stands, and the company cannot fine you.
When you start getting the threatening letters, come on MSE, but never be tempted to give in. The cowboys will escalate the "fine" for a few weeks/months, then drop it when they realise you won't pay.0 -
Just to let you know i recived an email today to say my appeal has been heard and the ticket cancelled thank god for that, some times a bit of common sense is applied by private parking companies. Its a shame I cannot say that about the people that issue the tickets.0

Probably the "look we do read 'appeals' and sometimes say we will drop the charge" tick in the box when the man from the BPA pops around for a tea & a biscuit to make sure they are behaving in accordance to the code.
Either that or it's that damn work experience kid pressing the wrong button again0 -
Not forgetting their trying to look fair and reasonable to their friendly MP's regarding the Freedom Bill. We may well see a few more allowed appeals. They would have to go some to get their averages up.0
