Parking ticket to pay or fight

On Saturday i got a parking ticket from UK Parking control limited on a retail park in Strood Kent:mad:. For not parking my car between the white lines. But where my car was parked right at the edge of the car park where there is only a two car space right outside Carpet Right. The owner of the car that was parked next to me was a good distance from my car, and also had his two wheels parked on the pavement to the right of his car and was not on the tarmac but he did not get a ticket. My car had its right hand front wheel over the line but not my back wheels which where in, I do have a photo of the offence and two witness one being the owner of the car that was parked next to me and works at Carpet Right and was not leaving work till six that night. There is no parent and child parking so had to look for a gap big enough. Which i was still hamperd by the bin that was full to the left of my car so that is why the wheel was over the line. This was the last thing i needed after my wife had just come out of hospital on friday after suffering a misscaridge. I have emailed the ukpc limited to appeal the ticket but any other advice greatly appricated

Pay - No Way
Fight - No Way
Ignore - Oh Yes
Ignore UK Parking Control, they are a private company trying to claim a contractual penalty, sit back and think what material damages the owner of the retail park has suffered for your parking slightly outside a white line, it's nothing, not a penny.
So ignore it

second Mistake, not coming here for advice first.
Now the best advice in the land ; IGNORE IT
And ignore all the "silly letters" they will send, they are all complete and utter bull$hit.
Do not contact them again or respond to any contact they send.Hi, we’ve had to remove your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0 -
Well you certainly don't pay a parking charge notice, and there is no fight involved , you simply ignore the unenforceable speculative invoice completely.
Then job done
And best wishes to your wife and yourself, I have been through the same, its not easy fella, but keep your chins up, and try again when the time is right.Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?0 -
I have sent hem a picture in the email i sent them to appeal it am i done for now that i have given them the information they need?0

I don't think you have quite grasped the truth of your situation.
This is a private company they have NO authority to "fine " you.
They have no authority to require you to give informatikon to them.
They have no independent appeals process - they reject them all because they want your money.
What you have is an invoice , that is a request to pay.
If you choose not to pay the company could claim against you in a Small Claims Court but they won't and here is why,
1) The invoice is issued and the claim if filed on contract law.
2) They may struggle to prove that you entered into any contract.
3) if they can prove a contract they can only claim any losses / damages incurred by your breach of that contract -that can not possibly be the amount they have invoiced.
4) Enough mugs pay these fake scam tickets that the company does not need to waste it's time and money on court.
that is a short simplified explanation of why despite all the threats you may receive this company will not take you to court if you just ignore them, I personally have ignored three from a similar company.
take the best advice and ignor all future letters -if you are unlucky enough (0.1 % chance at worst) to get real court papers then come bsck for an adequate defence based on some of the points above.0 -
I guess you lot must have been through the same situation. Im just supposeing hypothetically if it was to go to court as long as you pay up if the court goes with ukpc no ccj will be put on you to affect credit rating?0

Please stop worrying. You will not be going to court.0 -
Correct although this is not going to happen , in theory there would also be costs.0
