Ebuyer failed next-day delivery- refusing full refund

I placed an order on Ebuyer.com yesterday at half two in the afternoon. I chose next day delivery for £7.49.
The item has not been delivered today, I have been in touch with Ebuyer who have simply stated that my order will arrive tomorrow, and they have therefore refunded £2, as this is how much I would have saved had I initially chosen the £5.49 Friday option.
Now, I understand where they are coming from but I paid good money for a next day service which they clearly failed to provide. As far as I am aware, it is the sellers responsibility to ensure I receive the item.
What really gets me is the fact that many people bought the same product, some ordered later than me, and chose the free 5 day delivery option and they have received their item today.
I wanted the product today. Had I wanted it later, I would have chosen the free 5 day delivery option.
Now, Ebuyer, or at least the rep I am in touch with are refusing to refund me the remaining £5.49. S/he is just stating that it is their policy to refund the surcharge incurred, which in my case is £2.
What are my rights, and what can I do? Has this happened to any of you? What did you do?

If you don't like their offer then you can always cancel under the DSR and receive a refund.0

I want to keep the product. I forked out for next-day service which I have not received. I did not request 2-day delivery, and even those who chose free delivery with the same product have received the item before me, next day!0 -

That happens quite a lot with Amazon. There are two types of people in the world: Those that can extrapolate information.0 -

Why have you started two identical threads?Accept your past without regret, handle your present with confidence and face your future without fear0

If you want to keep the product then why not let it lie, was there a specific reason you chose next day, i always choose free delivery as its been quite quick in the past.0

If you had opted for the 5 day free service then there would have been no guarentee to receive it in 2 days. Those other customers were just lucky to get them faster than promised.
They've done the decent thing and refunded the surcharge so it seems fair to me.0 -

Yes, but my order should have been prioritised as I paid for next-day service. I contacted Parcelforce who stated that they received the parcel at 2am this morning so it would obviously be impossible for it to be delivered today.
I paid for next-day delivery service. I was not provided with this service, I don't see why I should be essentially "forced" to pay for a service which I did not ask for, which is 2-day delivery in this case. I wanted it today, I didn't receive it today, and if possible, I would have chosen 5 day delivery upon finding out today that i wont be delivered today. Obviously this is daft and impossible.
I paid for delivery today, I didn't receive it today, so it is, in my opinion, completely reasonable for me to expect a full delivery refund, which I have now received.
I know I sound stubborn, but I wanted it today, not tomorrow!0 -
Next day delivery items will be travelling through the night, so Parcelforce receiving it at 2am isn't that big of a deal.Still time to sort it and get it to the relevant depot.
Good result on the refund though.
