I believe you need to have something with your NI and name on it.. so a P45 or P60 or NI card.. along with a birth certificate that includes at least on of your parent's names.

If you actually read that document, you'll find that an expired passport is acceptable in certain situations.
The UK Border Agency recommends that employers check the in-date passports/travel documents of their prospective employees. However, if the prospective employee does not have an in-date passport/travel document showing their permission to remain in the United Kingdom11, you can accept evidence of permission to remain in the UK – and therefore right to work - in an expired passport or travel document. It is crucial that you check that the stamp or endorsement in the passport/travel document continues to allow the person to work by virtue of status (ie the person’s stay is indefinite) or date (the end of the person’s permitted stay has not expired).
I think I found that on page 20. It's part of List A, anyway.

So, OP, you should be fine if it's a full UK passport with no restrictions, and you look roughly as you did in the expired passport. However, you may need to be ready to quote 'chapter and verse' to future employers.

CRB checks are different: the passport isn't being used to check the right to stay in the UK, but that the person is who they say they are. But I didn't read the rules for that: the application form asks if you have a VALID UK passport, so if you don't, that section would be blank and i wouldn't want to see your passport anyway.

A NINo doesn't establish right to work, btw, only that you HAVE been working.

Yes I know. I saw a list somewhere that said that if you can't provide a passport you can provide something with NINO on it with a full length birth certificate.

@ Savvy_Sue The employer doesn't have to accept an expired passport, they can but doesn't mean they will.

    I would argue against this.....

The situation this is talking about is if the person, for example, has been given Perminant Residency status in the UK they will have a stamp in the passport that states they have no restrictions on their activity and the certificate ALWAYS has a 10 year expiry date even if the passport itself has less than this.

In this circumstance they are saying you can still use the "passport" even though its expired because in reality you are using the visa/ certificate inside it as the proof of eligibility to work in the UK not the passport itself.

Whilst it is true that just because a British passport has expired doesnt mean you have stopped being a UK citizen it does mean that the document can no longer be trusted to prove you still have your British nationality.

Certainly there are some circumstances where you can use an expired passport but they will rarely be in connection with proof of nationality or identity - more in the case of proof of age, even if you've lost your British nationality you arent going to have changed your date of birth :p

    Do you have other ID?

When I applied for a job recently and told them my passport had expired they said I needed to bring suffcient other ID (ie - full driving license and birth certificate)

Why not? A passport that has been cancelled will have one corner cut off.

They could have nationality of another country and have recinded their British nationality but kept the expired passport. (A friend in UAE has got Emiriti citizenship but has kept her 4 yr out of date UK passport but she is no longer UK citizen and has no right to work here anymore as she is no longer a UK citizen even though UK by birth. It is illegal to have dual nationality in UAE)
