    I hope you get the cash out of them today. I can't believe that your store manager hasn't done more to help you. I think if I lived in your area and was going to Asda today I'd be tempted as a customer to go and demand to speak to the manager and tell them how awfull I think it is and that if they didn't sort it out for you I'd ensure it got a lot of local press in the new year, and not the kind they want. I would imagine that a LOT of it's customers would be more than happy to boycot the store for a couple of weeks if they knew about it.
    I don't think it's a threat that you should make, but if a friend of a friend (you had told in confidence) happened to hear about your misfortune..... (and good old you had even borrowed money to travel into work because you couldn't let them down ;) )
    It does depend how urgently you need this money - but without a doubt, if they do nothing please do make sure they refund you for any charges that are made as a result of late payments - and remind them that they've also caused damage to your credit record.

    good luck with this. i work for tescos and i should get 6 weeks at 90% pay and i have only got 3 weeks, my payroll dept said i wont get the missing money until i go back to work in April and my pay reverts back to store instead of head office as they can't sort out payroll errors at HO level when it relates to maternity pay.(maternity dept is in india and they are all stupid and can't add up, there are 6 of us on mat leave and not one us has been paid right this month!) my husband also never go paid his paternity pay and we told them that we needed the money to pay the morgage (not true but they didn't know that!) and they gave us £400 in cash from petty cash.
    hope you manage to get it sorted

    Hey folks just an update! Went into work today to see payroll but they have xmas eve off and not back until a few days after xmas! How lucky of them! They wont do nothing and my manager cant do anything so i am at a real loss! I managed to get my pressies but will have to find the money for my bills! Booo!

    Does anybody know if there is some kind of thing to say that they are in breach of contract? I have done the work like but no money to show!!! x
  • Hmmm, the wonders of retail....This happened a number of times to me when I worked for the C*apphone Warhouse - once being the begininng of December payroll, and they told me I could wait until the next payday (16th - early for Xmas)...wasn't until I got spotted walking 10 miles home from work by my Area Manager that they did anything (and my lovely AM lent me £100 out of his own pocket to tide me over).

    Worst one (bear with me) was in March though. CPW payroll actually consists of loads of departments, basic, mobile commission, bonus, insurance commision - you get the idea. Anyway, I got an email the day before payday from the commissions departments, saying ooops, sorry, your commission hasn't been paid...it'll go in on Friday. Ok I thought, but Friday came and went without my cash being paid in (so I'd been paid £500 only...). I called payroll, only to be told I wasn't paid becuase I owed THEM money! I'd had no payslip, no one would explain how any of these figures made sense.

    So, in the end, (three weeks after payday!) I sent an email to HR, my Area Manager (new one :o ), Divisional Manager, and Charles Dunstone and told them that as I hadn't been paid, and they were breaking basic employment law by not providing me with a payslip, I concidered myself sumerilly (sp?) dismissed. Got sorted in 2 days!

    All I can suggest is that you talk to your manager and say look, it's nearly xmas, and I'm skint - because of payroll...what can we do to tide me over....then shout at payroll when they open again until they agree to a transfer. Also save up any letters etc, which state that due to you missing a payment that they will charge you...and pass these on. As it was their mistake, they can pay!

    What an awful thing to happen. So sorry to hear about this. I really hope that despite all the hassle you manage to have a great Christmas.

  • An earlier poster is right. You have a contract of employment. The agreement is that you work and they pay you. Your contract will probably say which day of the month you get paid - if they have not done this, they have broken your contract of employment.

    They are responsible for any costs arising from not paying you on the correct day. This means cc charges, overdraft charges etc etc. (With any luck you should be able to get them to pay for having your phone reconnected, as well, on the basis you would have been able to avert this if you had been paid correctly).
