Mobile Phone Contracts
Hi, can anyone help.
If I have been given information by a company's customer service department about the terms of a contract before ordering it, and then going ahead with the order based on what they have told, what rights do I have if the company is now saying the customer service advisor gave me incorrect information?
Basically, I ordered an iPhone with Vodafone last year and have tried to downgrade the contract recently. They are now saying that I am not allowed to downgrade the contract despite being told initally that I could change the plan at any time.
Does anyone know what my legal rights are if I have been given incorrect advice at the time of ordering the contract?

If you can prove you were mislead - and I mean prove it - then you should be able to insist on getting what you want.
Now I do not for 1 minute doubt you are telling the truth, but if you can't prove it, then you are up a gum tree. I do, however, think that they did not say you could "downgrade at any time" otherwise you could have done it a month later, thereby wrecking any pricing structure for handset costs that often apply to low-cost contracts.
Never ever rely on a verbal promise unless you record it or ask for a copy in writing.0 -

Hi NJF1,
I am sorry to hear there has been some misleading information regarding your price plan.
You can change your price plan at any time, but this does not include lowering it mid contract.
If you would like me to take a look into this further for you, you can email me via the address shown here with WRT135 FAO Heidi in the subject. Please also include a link to this thread.
Kind regards,
Heidi
