Hi all..

This is a bit long winded and my first post here so please bear with me.

Overview.
I had a contract with '3' for 24 months starting mid October 2007 with a mobile phone of which i had seen through to the end without any missed payments.

The phone was used until i had moved house. I had no decent signal with '3' from my new home, but without complaint I opted to see the contract through but in the mean time had ordered an 02contract phone which worked well.

I had a call from three in September 2009 reminding me that they could offer me an upgrade, to which I told the operator as i could not get a signal so I would not be renewing the contract. He did try to give me various options but eventually agreed that it was common sense not to go ahead with a new contract. He did say to call nearer the time the contract was due to end and then tell the operator to cancel.
This was done near the end of October.

I expected the contract to run over 30 days after my call and then for any more direct debit payments not to be taken.

( PLEASE NOTE THE PHONE HAD NOT BEEN USED SINCE OCTOBER 2009 )

Three continued to take payments thereafter and I had only noticed in January after looking at my bank statements online.
I had cancelled the direct debit thereafter finding out, only to be bombarded with calls from three saying that if i did not pay the amount due then they would seek to reclaim supposedly owed money ( please remember by now i was 3-4 months out of contract ).

On every conversation I had with three I explained the same story, The operators could see the conversations that i had between the previous operators Sept/ October. And they still pressed on to reclaim some £93.00

OK,in hindsight, I accept I had failed to get a written conformation from three but should this be allowed for three to bully me.. I was out of contract.
I had 2 collection agency's try to collect money from me but again explained to both of them the situation and they returned to three.

Earlier this year i did a credit check on myself, only to find that '3' had placed an unpaid DD onto my credit score knocking it down by over 50% (380) according to experian.

Would anyone like to comment on the above as I know have a little time on my side to get this corrected.

Kind regards

Lee

I had two contracts with three and when I cancelled I did it in writing by sending a recorded letter to their executive office in Glasgow. The contracts were cancelled and they also provided me with written proof of the cancellation.

It is always better to cancel a moblie phone contract in writing never over the phone here the address for the executive office

    Hi Lee,
When you say the operators could see the conversations ...do they admit to one that cancels the contract or not ???
It's not just about the money

You should never cancel a DD until you have received and paid the 'final bill' from you supplier be that mobile, Sky, gas, elec etc.
Whats the point of having online bank statements if you only check them every 3 months?

No, in the last few conversations I had with three ( Feb/ march 2010), they just told me that they could see there was a conversation/ calls made between somebody at 3 and myself in September/ October and November

Thanks for the address supplied, I will use this for correspondence.

Would it be worth me asking for any information they have on conversations between myself and '3' under the ' freedom of information act ' before I start a formal complaint?

I do agree with the many wise words on all your posts, but that time has been and gone and I would like to try and get this damn mark on my credit score removed.

    Many thanks again

Freedom of Information Act applies to Public Bodies and 3 are not covered.

You could ask under "Data Protection Act" subject access request, but that will cost you £10 and you may get a better result by writing to Head Office, explaining that they have your call on record but the CS rep appears not to have processed your order.

Ask for your subsequent payments back and for your credit record to be amended

I just called up and cancelled no prob last bill said it was clossing one too
Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.
