Stand your ground and just ignore them, keep your cop safe, keep all the emails etc and just don't enter into further correspondence for the time being. I would be very surprised if anything else happens. Sounds to me like they have tinkered with it and its gone a bit wrong.

Forget about it. They're chancers. They had their one chance to claim and they've blown it.

Thank you everyone for your replies!
I checked on the paypal website and it says they can do a credit card charge back for an item not as described! I'm not convinced I won't hear from them again...after all it has been 2 months and they are still trying!
What happens if I get the item back and it is badly damaged by them opening it?
I'm just in 2 minds what to do!

If you get it back then post asking for advice, they haven't sent iit back in the last 2 months they have left it too late to claim through paypal or ebay. So try not to worry. As hammyman said they're chancers.

How did you post it, special delivery or courier?

If theyve opened a dispute once, then i don't think they can open another on the same item?

They sound like they are taking the !!!!, really if it wasn't working then they would have followed up the dispute surely!

They also mention that they have video evidence of when someone took the laptop apart to look inside, and will be happy to take me to court.

If they e-mail again you could mention that when they take you to court, you will be happy to hear them try to explain why they took the laptop apart and then tried to claim a refund.
Would he have done this with something from Comet, Dixons etc?

The fact that he has taken it apart means that he has accepted ownership of it.

    Sale of goods act.
    35 Acceptance.

(1)The buyer is deemed to have accepted the goods [F35subject to subsection (2) below—

(a)when he intimates to the seller that he has accepted them, or

(b)when the goods have been delivered to him and he does any act in relation to them which is inconsistent with the ownership of the seller.

Ask them to send you the video of them taking it apart.

Proof of them taking it apart and tinkering with it can't do your defence any harm if needed.

I cannot add anything than to concur with others.

Ignore them, they opened a case and it timed out. They can now only hope to convince their card issuer to open a chargeback, but they only have 180 days from purchase to do this. If the do this, then come back here for advice, but to put your mind at rest, your certificate of posting will ensure you keep your money, so keep it safe.

As for the Court, if the buyer cannot work with a paypal case, he would probably not even get started with Court. So don't worry about anything he hasn't done.

Thank you so much for your kind replies!
In the email they sent me it says if they win the credit card claim then I will have to pay fees and the cost of them posting it back to me! Is that true?
I don't know when they opened up the laptop, if it was before or after they demanded their money back! They just said during the dispute that they opened it up to confirm it was damaged!
If they do take me to court and they win, what will happen? Will I have to pay fees aswell as give them their money back?

By opening up the laptop, surely they have voided any warranty on it???

Also, why on earth would you open a laptop up for a key not working and the mouse not working? The mouse not working is likely to be software error, and just needs the correct driver re-installing (mine did this, but with the scroll bar at the side of the mouse pad), and the key sticking is probably a biscuit crumb stuck underneath, and just needs an air can to blast it out.

In theory, if they do try and claim, you could counter claim for them having voided the warranty by opening the laptop, all of which they've already admitted to on email!
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)
