faulty pushchair who is liable,what are my rights?

I purchased a twin pushchair combo in october 2010.my babies were born in jan 2011.I have used the car seats only with the pram and kept the bigger sports chairs in storage until my babies reached the right age to use them.I got them out recently and one of them has a broken strap.I took it back to the shop and they told me that all faults are forwarded to the manufacturer,I thought it was upto the shop to offer a replacement within 12 months.They say the manufacturers only offer 6 months and that the seat is clear of that by 2 months.I explained that the seats obviously wouldnt have been used in that time frame as my babies were to young to go in them.Am i getting fobbed off,what are my rights help please.!!?

    they have to ofer a refund, repair or replacement within the first 12 months if the product has a manufacturing fault - that could be the retailer or the manufacturer who offer one of the three options.

    If the items were damaged through use then you are not covered - you have to offer the manufacturer the chance to repair it if they so choose to - they do not need to replace, they have the choice.

    Thanks,the shop were trying to tell me that the manufacturer only gave 6 months.I know that the part cant be fixed so im guessing i will need a replacement can i ask the shop for this now or do i need to wait for the manufacturer??

    whos the manufacturer and was it current or refurbished stock?
  • This is awful! As far as I know, the manufacturer is liable for repairs and the shop to send it off for those repairs, up to 12 months since the date of purchase. Do you still have the receipt to prove purchase? I would call Consumer Direct to confirm but this is what I was told when my pram brakes went.

    yes i have receipt thankfully.The part of the pushchair that has broken cant be fixed so a whole new unit would be needed,would i have to wait for the manufacturers to send one or can i request that i want one from the shops stock??

    the manufacturer is obaby and the item was bought as current stock brand new.

    ok looking around you need to give the store the chance to send it to the manufacturer for repair or replacement if necessary - you can't insist on replacement from stock - it would be down to the store/manufacturer - I'd ask how long the repair will take and if its going to cause you lots of problems then point this out to them - but you are obligated to provide them a fair opportunity to repair the item

    thanks for your help,ive been warned that obaby can be a very SLOW company to deal with my babies are five and a half months old now and wont be on the car seats for much longer so i hope they arent too slow about it.What would you suggest a good time frame to be for them to get back to me?
