Grounds for Termination?

Hi,

Im 15 months into my contract with o2, until May I had been getting unlimited text messages and 100 minutes for £15 I wanted to simply add a bolt on and the only way i was able to do this was via phone customer services. Once I called this was sorted I was told 4 times I would still have my unlimited messages. I was then billed £56 pounds once i noticed this i checked my account and found they had changed my account from unlimited texts to 500 texts. On further investigation i also found my next bill had charges of £470 for the messages I had been sending.

I then contacted o2 and they did tell me I wouldnt have to pay the extra charges for the £470 bill and it would be sorted within 2 weeks this is still not sorted and i still have not been refunded my extra money from the previous bill.

Do I have any reason for getting my contract terminated? as it says in their terms and conditions :-

5.3 You can end this Agreement without having to pay the Monthly Subscription
Charges up to the end of any Minimum Period you have left, if:
(a) we increase your Monthly Subscription Charges by more than the Retail Price
Index (RPI) annual inflation rate at the date we notify you of the applicable price
increase; or
(b) we increase any of our Charges (apart from for Additional Services) in such a
way that would have increased your total bill for the immediately previous month
by more than 10% (if the increase(s) had applied for the whole of that month).

    They have not increased any charges. They made an error and admitted this. They just are dragging their feet with correcting the error.

    I don't see any grounds for cancellations, but you can try your luck.

    Thanks for the reply, they seem to be refusing to refund the extra £35 they took back into my bank account only my o2 account which is highly frustrating and thought this may have given me grounds oh well! Thanks

    Isn't that 4000 text messages? Or one every fifteen minutes.

    Totally irrelevant I know, but a bit gobsmacked.

    If 4000 is a correct estimation, I make it every 11 minutes. 24/7 day and night.
