Carphone warehouse - Can i claim a new phone?

Is there anything I can do about Carphone warehouse sending my 5 week old phone off for repair to manufactures and it taking 2/3 weeks to fix?

CPW warrenty is 28 days but does the sale of goods act cover it as it is not fit for purpose (no signal) or are they allowed to send it for reapir and it to take 2 /3 weeks?

I had posted before as a vent but I am now wanting my phone back and getting fed up waiting.

they are entitled to repair, replace or refund. Ironically you are angry at CPW but its the manufacturer whos to blame - HTC took three weeks to repair my phone and when I got it back it was more broken than when it went in.

What brand is the phone? Is it CPW doing the repair? You can't do anything about it right now I am afraid, as you have to give the retailer the opportunity to fix the problem by one of the three options above...

Yes but any remedy must be performed without causing a significant inconvenience. OP, have CPW given you a loan handset in the meantime?

Yes, but they are also allowed a reasonable time frame to repair before significant inconvenience comes into it. 2/3 weeks is considered reasonable.
