atos phone call regarding wca medical

  • I told them I didn't use phones - avoided any bother from them.

I filled out the ESA50 carefully though, and avoided any need of a medical.

Always ask ATOS who is the HCP that's going to give you the medical. Ask for their name, what they are, e.g. a doctor, a nurse etc ask for their professional body and registration number. Keep these details in case you need to appeal since if the appeal goes in your favour you can report the HCP to their professional body, e.g. the GMC, and they may take action against them for acting against the patients best interest. Currently around six doctors may be struck off because of this and there are cases of ATOS using non registered HCP's (Health Care Professionals) to conduct medicals, which is illegal.

No, my laptop was infected, something intercepted the device drivers, and all sorts of unknown nasties could have been on it (not that any av tools could find any) so I have had to sort out getting a os reinstallation. Hence lack of posts for a bit.

The impact of this is to stigmatise people on benefits,
and we should be deeply worried about that

Do you have a source for the bit I put in bold, about ATOS and unregistered HCP's? Never heard of this before that I can recall. Are you talking about being approved by the sec of statem or GMC/NMWC registration, or what?

When I went for my first assessment, I was seen by a nurse, which I thought was fair enough at the time. However she was under the impression I was only there because I am diabetic, but when she saw my crutches and saw my mobility issues, she told me that she shouldn't be seeing me and a doctor should because she was a trainee nurse who didn't complete her training!

    yikes...

    Did you get her name?
Depends how long ago the assessment was, but you should be able to request a copy of the medical report, which will have the assessors details on it, and you can confirm with the nursing and midwifery council what her status was at the time of the assessment.

Thats newsworthy stuff, if it turns out she does not meet the legislative requirements to be an assessor, and worthy of exposure, if that is the case.

I agree. There's multiple problems arising here. I would have thought no specialist background would be required (according to the current system) to assess the sorts of problems she has and therefore any assessor should have been qualified to do the medical.

There's then the problem of whether this person was a qualified HCP at all and whether they even had disability assessment training as required.

Then there's possibly the problem of whether due process was followed in advance of the medical - it sounds like no documentation regarding the claim was read in advance of the medical or that the wrong material was read. (Possibly, as I suspect in my case, the allocated medical professional was not the one who actually did the medical as they may not operate properly.. but instead a 'conveyor belt' type approach to who they assess on or close to the assessment day)

It sounds exactly like a case that would raise the eyebrows of the press and have alarm bells ringing regarding internal ATOS procedural and legal failing. I mean we could be talking about an assault.

I didn't get her name no, as you know these things happen there so quickly it can get a little confusing if it's anyone's first time. It was on Sat 12th Sept 2009 and I didn't receive a medical report then, which I'm guessing would have been completed by the doctor, however I did get a report from my second assessment on the 12th November 2009 automatically.

I guess it's hindsight that we all wish we could have.

if she was claiming to be a nurse and is not registered with the nmc. which she can't be as she failed to finish her training. then she has commited an offence. a nurse must meet a minimum standard of training and to meet health and fitness to practice targets. otherwise they could just get a person off the street to assess you. i would refuse to be seen by an unqualified person and report atos as well. very bad of them.
