Buildiings insurance excess

About 8 months ago the flat upstairs started leaking into my flat causing a lot of mess on my walls. I contacted the management company and was advised that a plumber would investigate. I was informed that the leak was due to a leaking washing machine pipe and it had been repaired. I then contacted the insurance company who sent out an assessor who then arranged a repair and was then given a number of a repair man who was supposed to come and do the repairs. I emailed him, I sent him text messages and phoned him to no avail and waited and waited and waited. Finally I got in touch with the insurance company again and they have come out to to do the repair and have found that there was a secondary leak which has continued into the walls of my flat. The repairs have taken place and i have made a claim on the contents policy also however I have two questions to ask:
1. do i have to pay the excess on my claim even though the incident occurred through no fault of my own and indeed was caused by the washing machine being fitted (even though there was a secondary leak?)
2. My iphone 4 was left on the window sill which was, unbeknownst to me sopping wet underneath the gloss. When I came back from a trip abroad the phone did not work and I couldn't for the life of me work out why so i took it to a local repair man and he said that there was water damge to the phone which didnt make any sense at that time as it had been sat on an ostensibly dry window sill for five week (I left it home so as not to get lost as i haven't gotten round to insuring it yet and I own the set outright) However when I saw the window board it was soaking wet underneath and the moisture must have seeped into the phone over the weeks causing the phone to die - (I know this is long winded sorry) anyway contents insurance are saying that I am negliegent for leaving the phone in a previously damp area however I have said that it wasn't damp at all and that the damage has occurred while I was away - who is right who is wrong? HELP!!!!:eek:
